The Commercial Court number 2 of Las Palmas de Gran Canaria has released a resident of Lanzarote from her debt of more than 12,000 euros and has allowed her to keep her vehicle and the rest of her assets.
This case has been managed by the firm Curquejo Abogados, who have described this judicial resolution as "a new success story for those seeking a legal solution to a situation of over-indebtedness."
The Second Chance Law makes it possible to cancel, under certain requirements, the debts that cause insolvency, facilitating their economic reintegration without the pressure of accumulated defaults. In this case, the affected party went to the Courts after finding herself in a situation of insolvency that prevented her from meeting her financial obligations.
After analyzing the case, the Commercial Court number 2 of Las Palmas de Gran Canaria ruled in favor of the applicant, granting the Exoneration of Unsatisfied Liabilities (EPI), and the latter retaining her assets, which implies the total cancellation of the debt and the possibility of starting again without financial burdens.
A ruling with a positive impact for citizens
The firm highlights the importance of this judicial decision for those people who find themselves in similar situations.
"This decision demonstrates that the Second Chance Law is an effective tool for those who really need and deserve financial relief. There is a high number of people who are unaware of this legal mechanism and continue to be trapped in a spiral of over-indebtedness. Our job is to advise them, accompany them and help them recover their stability and economic prosperity,” says Erik Curquejo, lawyer at the firm.
The case highlights the relevance of this procedure as a solution for those who, without having acted fraudulently, have accumulated debts impossible to face. More and more people in Spain and the Canary Islands are resorting to this legal avenue to restructure their financial future.
