A matter of dignity: 15 years without economic and labor improvements

Neither the members of APFP nor those of the other trade union organizations deserve, we deserve, the smear campaign that has been launched against the group, and even less so when it comes from the Penitentiary Administration and the head of the Government in the Ministry of the Interior, to be persecuted and publicly humiliated by those who should protect us. They have been able to violate the rule of law with prison workers, deny them their presumption of innocence, criminalize their actions, sentence them to prison for a simple complaint from a Director or from the Deputy Directorate General of Analysis and Inspection, based on complaints or statements from inmates, without any evidence or probative indication of criminality. Applying a policy of "guilt" towards its workers, abusing the disciplinary regime and applying the provisional suspension of employment and salary as punishment and mockery for the group. All this is more than enough reason not to have anything to celebrate today on the Merced, when your life and that of your family means shit to them.

Respect for oneself, for our profession, leads us from the Professional Association of Prison Officials APFP to denounce one more year that prison workers have nothing to celebrate on September 24, the day of the Merced patron saint of Penitentiary Institutions. We exercise our right to say ENOUGH!

Enough of TYRANNY and instilling fear in a state of law. ENOUGH!! of Ortiz and Marlaska. Prisons are represented by, we represent, the 24,000 men and women who carry out their work with responsibility, dedication and commitment 365 days a year, 24 hours a day. They will leave, and we, you, an example of professionalism, will continue to demonstrate with your values what is the path that the penitentiary public service should follow, degraded during this legislature as no one could imagine.

We have asked our colleagues to refrain from participating in any of the events planned for the day of our Patron Saint, Our Lady of Mercy. A decision that we have considered necessary in the face of a situation that we understand is unsustainable for the professionals of Penitentiary Institutions.

We would have liked to accompany those who have been congratulated and recognized for their professional work, many of them after 25 years of hard and sacrificed work for the benefit of our society and without social recognition. Congratulations, colleagues.

The causes that have led us to this situation are numerous, but, concisely, we will specify them in the lack of personnel in practically all penitentiary centers and social insertion centers CIS; the unfulfilled promises of economic and professional recognition, as Agents of the Authority, and the organizational chaos in the personnel policy and the lack of expectations in our administrative career and without reclassification to group B.

We have nothing to celebrate while the prison population suffers the neglect of our rulers for more than 15 years, and suffers social discredit by criminalizing and questioning our Constitutional work of service to society and maximum respect for the rules of legality of coexistence within Penitentiary Establishments. We are neither abusers nor executioners, no matter how hard Mr. Ortiz and Minister Marlaska try. We are public servants who deserve respect for our dignity and profession.

From APFP we appreciate the trust of the colleagues who have placed in us and, likewise, we assume this growing and constant support of new members with the greatest of responsibilities, committing ourselves to continue developing the exclusive union project in the field of prisons, without releases, without public subsidies, in which we have been working in recent years, so that we can continue to advance in the conquest of the improvements that we prison officials deserve. And above all, thank you for your support, involvement and understanding.

There is nothing to celebrate on the day of mercy while our prison managers and unions that claim to represent us at the negotiating tables continue to allow:

Aggressions by inmates are our daily bread, with one aggression every 36 hours. Many of them go unpunished in the face of the need for a new "forceful" sanctioning regime to eradicate any type of violent behavior, whether exercised against officials and/or inmates, essential for a process of behavioral reinsertion and coexistence in society.

The PEAFA has only served to "WHITEN", the Government hiding and manipulating the figures of the aggressions and justifying the Administration that the fault lies with the prison workers to publicly discredit their just demands.

The "conflict" of prisons increases and produces an average of FIVE SERIOUS REGIMENTAL INCIDENTS EVERY HOUR. Every day we risk our lives in the different penitentiary centers, mediating in fights and settling of accounts, putting out fires, saving inmates from overdoses and suicide attempts, to receive a miserable salary from 20 years ago.

The lack of personnel in more than 2,700 positions of the RPTs, an average of 15% of the positions of officials in all penitentiary centers with respect to the provision of personnel estimated by the Administration. According to the latest data, as of June 2022, in 1,701 positions for C1 positions; 339 for C1/A2; 342 for A2 and 394 for A1. Special mention is the situation suffered by the penitentiary health personnel, especially the lack of physicians (doctors) with 67% of the positions of physicians unfilled. Between 2021 and 2022, a total of 80 positions were offered, of which only 11 have been filled.

From APFP we claim as a basic principle of DIGNITY:

A OWN STATUTE for prisons that includes the peculiarities that make up the prison service. Total rejection of the Law of Bodies, known as LAW OF STORIES, negotiated and signed by the unions of the tables.

Consideration of AGENTS OF THE AUTHORITY, reinforcing the principle of authority that must govern inside the center to guarantee good order and peaceful coexistence of the prison population. We work with people unadapted to social norms.

Right to the PRINCIPLE OF INDEMNITY in the collection of civil liability at the expense of the Administration in case of insolvency of the inmates.

A OWN REMUNERATION FRAMEWORK for prisons, where our profession is remunerated with SALARY DIGNITY for all functional areas of work. Creation of a SHIFT BONUS as the police charge (120 euros per month), for performing morning, afternoon and night services. Likewise, the collection of HOLIDAYS, SUNDAYS AND NIGHTS.

It is necessary to adapt our remunerations to the functions we perform and the responsibility we assume, with a level of salary supplement derisory in comparison with other groups, with more than 2,000 jobs with a level

 We demand the minimum level 18 for all positions as it is an essential service for society and provide direct and personal attention to family members and inmates.

SALARY EQUALITY WITH CATALONIA, in terms of specific supplement, starting progressively from the reclassification of centers to a SINGLE CATEGORY OF CENTER, creating a monthly productivity in three sections depending on the dangerousness of the inmates and other factors that allow us to adapt certain dysfunctions in the work to the current reality.

Adapt the PRODUCTIVITY FOR ABSENTEEISM, for an amount of 107 euros monthly linear for all positions, to the productivity of the ministries and that today exists for officials assigned to the Central Services of the SGIIPP and EETPyFE, according to Instruction I 1/2022 dated July 11, 2022, with the following amounts corresponding to the jobs of the following levels:

Level 28: 615 euros / month 

Level 26: 555 euros / month

Level: 24: 440 euros / month 

Levels 22-20: 405 euros / month

Levels 18-15: 375 euros/month

All this for a working day of 40 hours per week, 2.5 hours more weekly average, with respect to those currently performed in the peripheral services (penitentiary centers). That is, an economic compensation of between 405 and 375 euros for working 10 hours more per month for positions of levels 15 to 22, an average of 37.5 to 40.5 euros per hour.

Adaptation of the amount of PRODUCTIVITY FOR EXTRAORDINARY SERVICES (known among professionals as peonadas), regulated by Instruction I 11/2019 of June 19, with the same hourly amount as that received by officials assigned to the central services, from 37.5 to 40.5 euros per hour instead of the current 15 euros/hour.

A UNIVERSAL TRAINING for all prison workers, without quotas and without exclusions by centers at the expense of the Administration, through a TRAINING SCHOOL. Likewise, that allows to obtain the necessary qualification for the reclassification of the Body of Assistants to group B.

Reclassification to GROUP B to all officials of the Body of Assistants without annual quotas depending on the economic availability according to the budgets of the SGIIPP.

Adaptation of the relations of jobs (RPT) to the current reality of the penitentiary centers, guaranteeing the COVERAGE OF 100% OF THE RPT. Likewise, the negotiation and adaptation of the RATIOS of officials per number of inmates/files/etcetera, to the current reality of the Centers with the creation of new positions such as MANAGERS OF MIXED AREA etc.,

Extension with general character in the provision of HEADS OF SERVICES, HEADS OF OFFICES, etc, with special interest to the situation, the lack of provision of personnel of the Social Insertion Centers, independent CIS, to the current demands of our society regarding the monitoring of prisoners in the process of semi-liberty, release, etcetera, what we call OPEN ENVIRONMENT.

Adaptation of WORKING HOURS to the current economic reality with an annual variation rate of the CPI of the month of August that stands at 10.5% and, avoid expenses in the displacement by the distance of the centers. For positions with schedules from Monday to Friday, without shifts, with two and a half a week, and in surveillance voluntarily the accumulation of a 24-hour shift (morning/afternoon/night) in their cadences of schedules for both the CIS and the penitentiary centers, with the possibility of adaptation (replacement of the night service by a morning or afternoon shift) for reasons of age to officials over 55 years of age in order not to be burdensome the accumulation of hours.

Adaptation of WORKING HOURS to all officials of SECOND ACTIVITY, with schedules from Monday to Friday, who voluntarily and regardless of position to develop want to perform two and a half a week.

In summary, from APFP we are PROUD TO REPRESENT AND BE PRISON OFFICIALS, but on the day of the Merced there is nothing to celebrate. YOU CANNOT WORK IN THESE CONDITIONS OF INSECURITY AND LACK OF PROTECTION. September 24 will be another Saturday, together with the colleagues of fatigues, hoping that one day our profession will be recognized with DIGNITY.
