The Yaiza City Council has already concluded the legalization file of another hotel, the Costa Calero, and in this case has concluded that the establishment can obtain a new license. Although the surface area of the hotel is greater than allowed when it was built, the new General Plan allows it to be legalized. This is because this document contemplates an increase in buildability when it is used "exclusively for common areas" of the hotel, as is the case here. 

In total, according to the reports prepared by the City Council, the establishment has a computed area of 26,983 square meters built, so it has 2,063 square meters more than allowed. However, by applying the "incentive" of buildability in common areas established by the new plan, it could reach up to 34,888, which are not reached.

Now, the property must pay the Yaiza City Council the amount of 63,331.60 euros "as recovery of capital gains derived from the increase in buildability applicable to the plot." As for the rest of the parameters, such as the number of beds and the maximum occupancy of the plot, the establishment does comply with the planning, so the City Council has already approved granting it a new license.

 

Three unlegalizable and two legalizable


The conclusion of this file is a new step in the procedure in which the City Council is immersed, for the execution of the judgments that declared illegal different hotels in the municipality. So far, the City Council has concluded that another hotel in Playa Blanca, the Hotel Rubicón, is also legalizable, while the Son Bou, the Princesa Yaiza and the Papagayo Arena would not fit even with the "incentives" contemplated in the new General Plan. In the case of Son Bou, the reports conclude that it triples the permitted buildability.

As for the Hotel Costa Calero, located in Puerto Calero, the technical report "determines that the building conforms to the parameters established in the General Urban Planning Plan of Yaiza in force." According to the City Council in a statement, "the establishment in question has authorization of Classification, Opening and Operation of the Cabildo of Lanzarote", granted in 2008, and the number of places, 680, coincides "with the category and capacity intended in the Memory presented and approved on May 21, 2015." Therefore, it concludes that "it meets the requirements demanded in the sector regulations prior to the granting of the municipal building license." That is, with the "prior authorization of the tourist activity and authorization of project, also having in this case with opening and operation according to the certificate dated January 28, 2016 issued by the Island Council."

Regarding the occupation, "this is within the parameters established by the Plan, 17,744.27 square meters, less than 19,663.44 square meters (45% of the plot area); giving an occupancy percentage of 0.41%", explains the City Council. Finally, it points out that the hotel "complies with regard to the heights, since it has 4 floors; and the maximum dimension of the height established in the planning of the General Plan, is 4 floors and/or 14.40 meters."
