The Cabildo's Heritage area has been at least three years without processing the complaints it receives from its own inspector and without initiating the corresponding sanctioning files. This is evidenced by a report signed by the jurist of this department, in which she gives an account of what has been done, or what has not been done, with 37 complaints filed since 2015 by the Heritage inspector. These complaints are included in a report issued by this official in September 2017, and among them is one against the Tourist Centers, for the removal of a stone from the Cueva de los Verdes without permission, and others against various companies and individuals.

After learning of this list, the Podemos group in the Cabildo raised a question to find out how many of these complaints "have been fully processed and "how many sanctions have been imposed as a result of these complaints". And the answer has come in a report from the jurist, in which she begins by pointing out that she has already warned both the area's councillor and the coordinator of the "accumulation" of work and in which she explains that she has appealed to the need for a "strengthening of the service's staff", which "contributes to working with the necessary and appropriate tranquility to reflect, study and attend to all matters".

Next, the jurist acknowledges that no "disciplinary proceedings" have been initiated, alleging that there is only one official technician attached to this service, who is the inspector himself, and that the law prevents the complainant from being the one who investigates the case.

 

The jurist "had informed" of the situation "on several occasions"


"The historical heritage inspector of this Service cannot be appointed instructor of the sanctioning files (complaining subject), and another technical official of this Cabildo must be appointed for this purpose", the jurist's report states, which affirms that this "has motivated that no sanctioning files have been initiated". In addition, she insists that "these circumstances have already been brought to the attention of the competent Council by this Council of Historical Heritage on January 31, 2018, after consulting both the General Secretary and the Legal Advice of this Cabildo". To this, she adds that she had also "informed on several occasions, verbally, of what is stated in this report".

Regarding the measures to be adopted, the jurist points out that she has received a "verbal order" from the councillor to "prioritize" among her tasks -"suffering from accumulation", she insists- "the realization of previous actions and report on the complaints" included in the report made by the inspector on September 22, 2017, "as well as the verification of those actions that had already been carried out and that I must carry out in each case". 

"All this without prejudice, if applicable, to what the official instructor appointed for this purpose decides to report and act. For my part, and taking into account the priority established by the Councillor, I will report as I carry out these actions", she points out, adding that she will also "extend" her report to the complaints received after the inspector's letter of September 2017. However, appealing again to the regulations, the jurist specifies that "in no case" her report "can be accompanied by a proposal" for a resolution, but only "information and previous actions", such as "facts, identification of the persons and the relevant circumstances that concur".

In addition to confirming that no sanctioning files have been initiated, the jurist's report also points out, based on the inspector's letter, that "the absence of some other complaint made by him seems to be noticed". As an "example", she cites the complaint for the "removal of a stone at the entrance of the Cueva de Los Verdes, without the mandatory authorization of Historical Heritage".

Regarding this file, she points out that "these facts already have a legal report" prepared by herself and points out that "its authorization" is "pending the report of said inspector". In addition, she adds that she will verify the "absence of some more complaint and the actions that have been carried out regarding them, reporting on them".
