The Agency for the Protection of the Urban and Natural Environment (APMUN) has imposed a fine of more than 96,000 euros on a citizen for a very serious infraction committed in Haría. The APMUN orders the restoration or demolition of the illegal works located on land classified, at the time of execution of the works, as rural protection of environments, according to the announcement published last Friday, June 3, in the Official Gazette of the Canary Islands. in the Official Gazette of the Canary Islands (BOC).
The fine and order of the establishment of the infringed legal order affect the construction of a semi-buried isolated house and a one-story building of 93 square meters of surface and two rooms - warehouse of 1.5 and two square meters. These constructions are located in the place called Los Lajares de Haría.
The sanction, which amounts to 96,742.05 euros, is imposed on the affected party as directly responsible, as promoter, of an administrative infraction, because the aforementioned constructions were executed without the mandatory territorial qualification and urban planning license.
The APMUN also requires the affected party to present, within a period of one month, the restoration or demolition project as the first step in the voluntary execution of what has been ordered and warns that if this requirement is not met, it will subsidiarily execute the replacement order at the expense of the offender, in accordance with the Law on the Legal Regime of Public Administrations and the Common Administrative Procedure. Likewise, it indicates that if it restores the altered physical reality to the previous state of affairs, it will be entitled to a 90 percent reduction of the imposed fine.
