San Borondón has denounced "the systematic breaches" by the Tías City Council of the specifications that must govern the concession for the installation and management of the market held on Fridays in the Plaza del Varadero in Puerto del Carmen. According to the formation, the awarded company stopped collecting a total of 72,432 euros during 2017 "due to the breaches" of the City Council.
The party states that "where 117 stands are currently set up every Friday", 131 should be installed, "which is what is reflected in said specifications and the final award contract", so that "there is a deficit of 14 stands per week that the company fails to collect during the year".
Likewise, San Borondón assures that "there are constant breaches in the continuous suspension of said market due to the realization of different activities, without taking into account that it is the place where it is installed every Friday". In this sense, he points out that "in 2017 the market was not installed for 12 weeks" and that "in 2018, to this day, we have already had eight weeks".
Thus, given that the awarded company must receive "the amount of 36 euros corresponding to the fee for occupation of public land" from each of the street vendors "and for each day the market is held", San Borondón estimates that, during 2017, the awarded company stopped collecting "due to the breaches of the Tías City Council" the amount of 72,432 euros: 20,160 euros for the 14 stalls that were not installed in the 40 weeks that the market was held and 52,272 euros for the 12 weeks that it was suspended.
Criticizes that the City Council seeks "judicial tricks"
San Borondón affirms that "the fee that the City Council must collect for the concession is 80,000 euros". Therefore, "if we subtract this amount not collected due to said breaches, the balance to be received by the company should be approximately 7,568 euros", points out the party, which will submit a motion to the Plenary for "strict compliance with the specifications".
"Since the Tías City Council is aware of these breaches on its part, it should not continue to judicialize these issues", adds San Borondón, which proposes "to initiate contacts with the company to try to reach an agreement that is beneficial for both parties or simply to benefit the truth and not use the power of the administrations to seek judicial tricks, with the aim of obtaining a prize for injustices knowing that they are carrying them out".
"That supposedly has a name and is called prevarication", point out from San Borondón, from where they add that "the technicians and politicians are there to guarantee that the laws are complied with where the rights and duties of our citizens are reflected and not only to ensure the administration that they represent at that moment".
