He has been his lawyer for years in almost all the administrative and criminal cases he has faced, but at least in the Stratvs case, Felipe Fernández Camero will no longer represent Juan Francisco Rosa. The businessman will now have a new lawyer, Margarita Alejo Hervás, who will handle his defense in this procedure.
The document reporting Camero's resignation and the appointment of a new lawyer was registered in the Court of Instruction Number 5 on July 15 and has already taken effect. From now on, Margarita Alejo will represent both Rosa and BTL Lanzarote, which is also charged in the case as a company.
In the Stratvs case, which led to the precautionary closure of the winery in December 2013, Juan Francisco Rosa is charged with a long list of crimes, including crimes against land planning, against heritage and against the environment, as well as document forgery and economic crimes.
Harsh questioning by the Provincial Court
After the precautionary closure of the winery in December 2013, Felipe Fernández Camero filed an appeal with the Provincial Court on behalf of Juan Francisco Rosa and BTL Lanzarote requesting its reopening. However, the Court not only rejected his request, but also questioned the defense presented by Fernández Camero.
In the ruling, the Sixth Section of the Court repeatedly expressed its "surprise" at the defense's arguments, emphasizing that the lawyer raised issues that had nothing to do with the appeal, but said nothing to refute the alleged illegalities of the winery and dedicated only "half a page" to discussing the substantive issue raised.
In addition, the Court questioned that the defense used "procedural and constitutional arguments" that had nothing to do with the resolution being challenged, that is, the order that in December ordered the precautionary closure of the winery. A precautionary measure "whose substantive reasoning they do not even discuss with more extension than half a page, which surprises this Court," it insisted.
Other previous resignations
This is not the first time that Fernández Camero has had to resign from the defense of Juan Francisco Rosa, although in previous occasions, this occurred because the lawyer himself became charged in the case, which prevented him from continuing to handle his defense.
This already happened in the Yate case, for the massive granting of illegal licenses in Playa Blanca, in which Juan Francisco Rosa was charged at the time. When Felipe Fernández Camero joined the list of defendants, Rosa had to hire a new lawyer. In this procedure, the actions against Rosa were eventually dismissed, but the case against Camero continues in a separate piece for embezzlement of public funds.
In addition, both Rosa and Fernández Camero are charged in the Unión case, so the businessman also had to entrust his defense in this case to another lawyer when Camero was arrested.
