Justice allows Somos-NC to correct its candidacy to Yaiza but rejects the one for Tinajo

The Contentious-Administrative Court number 1 has annulled the decision of the Electoral Board to exclude its candidacy to the southern City Council after the resignation of four members of the list, allowing it to "correct the defects"

The Contentious-Administrative Court number 1 of Las Palmas de Gran Canaria has agreed to allow Somos-Nueva Canarias to correct its candidacy to the Yaiza City Council, which was eliminated by the Electoral Board after four members resigned at the last minute from being part of it. However, the Justice has rejected the appeal that the electoral coalition presented against the elimination of its list to the Tinajo City Council, so it will not be able to compete in the elections to said municipality, as confirmed by the Secretary of Organization of Somos, Borja Rubio.

In the case of Yaiza, the Arrecife Zone Electoral Board agreed to exclude the candidacy of Somos-NC on April 29 "as it did not reach the number of candidates", in view of the resignation made in the afternoon of the day before and "at the end of the correction period" by four members of the list, specifically by Arturo Francisco Rebollar, María Dolores Rodríguez, Pedro José Vidal and María Zuleica Betancort. And, their withdrawals caused the list headed by the also Senate aspirant, Yoné Caraballo, to be reduced to 13 incumbents and three alternates, "lacking the mandatory number of 17 incumbent candidates".

Then, the coalition formed by Somos-Nueva Canarias filed an appeal against such decision, which has been upheld by the Contentious-Administrative Court number 1 of Las Palmas de Gran Canaria. In its ruling, dated May 3, the Court declares the nullity of the agreement of the Electoral Board to exclude the candidacy of Somos-NC for the Yaiza City Council and orders it to grant the electoral coalition "a period of 12 hours so that it can correct the defects of the candidacy and, if applicable, proceed to proclaim" it.

"And now we are in the process", said Borja Rubio, who confirmed that Somos-Nueva Canarias has already submitted the new list replacing the four people who resigned, and is now waiting for the Electoral Board to give its approval and proclaim the candidacy.

Somos Lanzarote-Nueva Canarias has not had the same luck in its candidacy to the City Council of Tinajo, which the Electoral Board also decided to exclude. And, although the electoral coalition also appealed against this decision, in this case it has been dismissed by the Justice, so that it will not be able to finally compete in the elections to said municipality.

In the case of Tinajo, the Electoral Board eliminated the candidacy of Somos Lanzarote-NC after verifying that one of the people who was part of the list, who is a citizen of the United Kingdom, "is not registered in the electoral census". Thus, although the electoral coalition argues that said candidate "is registered in the register", as she does not appear in the census, the Justice has endorsed the decision of the Electoral Board.
