The VI Lanzarote Labor Conference will address Social Law in times of crisis

The VI Lanzarote Labor Conference, organized by the Canary Association of Iuslaboralists, in collaboration with "Judges for Democracy" and other entities, will be held on October 6 and 7 at the Meliá Salinas hotel in Costa Teguise. This year it will be entitled "Social Law and its jurisprudence, in times of crisis" and will address, among other issues, the recent European ruling that equates compensation for permanent and temporary workers. It will also be attended by 5 of the 13 magistrates of the Supreme Court.

The subject matter of this year's conference, the organizers highlight, is "of maximum interest not only to jurists, but also to workers, companies and citizens in general, affected by the most profound reform of our social law since the enactment of the Workers' Statute: the 2012 reform or anti-crisis reform".

The sixth edition of the conference will feature five magistrates from the social chamber of the Supreme Court, with whom it will be possible to debate, among other issues, the recent ruling of the European Court of Justice, which this week ruled that compensation for temporary and permanent employees should be equalized. The ruling, they stress, has "shaken the foundations of labor law".

 

The crisis, a "convulsion" for labor law


"The financial crisis, which began in 2008, which erupted into an international economic crisis, affected employment and labor relations, generating profound convulsions in labor law, which has been remodeled in recent years in economic terms," said the organization of the conference. 

"Some have called the process dismantling of social rights. Others have called it necessary flexibilization and liberation of business limits to promote competitiveness and job creation. But all agree that the poor legislative technique of the great reform generated a prolonged situation of insecurity and unease, which has not benefited either workers or companies, and it should be the Supreme Court that, by means of a unifying judgment, was marking the binding jurisprudential path for all judicial bodies, shedding light and guiding the cobbled interpretive path," he says.

In addition to the Supreme Court magistrates, magistrates of the Superior Courts of Justice and the Provincial Court of Barcelona (commercial), professors of Labor Law and Social Security and other experts will attend this edition of the conference. During those two days, succession, outsourcing, illegal transfer or groups of companies will be discussed. The new forms of flexibilization of labor contracts, the latest jurisprudence on ultra-activity, conventional opt-out and collective dismissals will also be analyzed, especially cases of companies in bankruptcy, and a "dissection" of the most recent constitutional and EU jurisprudence on, that "chimera called reconciliation of work and family life" will also be carried out.

 

Manuel Ramón Alarcón Caracuel Award


In addition, as in previous editions, the Manuel Ramón Alarcón Caracuel award will be given in memory of the jurist. This award has an economic endowment of 500 euros and will be awarded to the best legal communication presented, in accordance with the rules available on the website of the Canary Association of Iuslaboralists, with all the information about the conference ( www.iuslaboralistas.com ).

The association has indicated that they hope to have an "attendance as large" as in previous editions. The meeting, they emphasize, offers the possibility of "debating the most diverse social issues, with a critical look at the new social law sculpted in times of crisis and enjoy, at the same time, a wide agenda of parallel leisure on the Island of Volcanoes".
