The Spanish Association of Civil Guards (AEGC) denounces that "the Canary Islands 112 has not notified the Civil Guard's COS of serious incidents on several occasions", notifying only the Local Police of the municipalities in which the notice had been given.

The security force's alarms went off after learning that the Civil Guard "had not received any notice” to send a patrol to the homes of Lanzarote where two reports of gender violence had occurred on Saturday, July 9. In addition, they emphasize that “the Local Police were notified”, who finally ended up requesting the collaboration of the Benemérita in one of the cases.

“The 112 is isolating the Civil Guard, ignoring that with this attitude, in addition to harming professionals whose mission is to ensure the safety of citizens, it also affects those who receive a deficient service by not putting at their disposal all the means that can be counted on”, they maintain from the AEGC.

“Perhaps we are closer to the scene of the incident and we can avoid the problem, but they don't call us”, they add from the association. “As long as nothing happens there is no problem, but if something happens one day and they don't notify us, there could be a fairly serious security problem”, they warn.

“Discriminatory treatment”

The Benemérita points out that it is a crime “too serious for someone to take it as a competition” and insist that “trying to favor one body over another only contributes to fostering a poorly understood competitiveness that ultimately harms citizens, as could have happened in the aforementioned cases of gender violence”.

"The 112 service depends on the autonomous community, so this discriminatory treatment would explain the little or no interest on the part of the regional politicians in reinforcing or implementing the troops on the island, since it gives the impression that politically the interest of the Canary Community is to promote local police and the autonomous police to the detriment of the State Security Forces and Corps", the association affirms.

“They are appropriating powers that they do not have exclusively, they are not authorized to make that assessment”, they point out. "Let's not fall into a village nationalism, remember that there are many Canary Islands civil guards wanting to return to the islands."

Therefore, the Spanish Association of Civil Guards asks the 112 to “resort to the State Security Forces immediately, without discrimination based on the color of the uniform that the agents represent and without delay to give the citizen the service they deserve and pay for with their taxes”.

Legal consequences

The AEGC warns that this situation “could constitute a crime because article 450 of the penal code would be breached”, which sanctions the omission of the duty to prevent crimes or promote their prosecution.

Specifically, it would refer to section 1 of the aforementioned article, which maintains that “anyone who, being able to do so with their immediate intervention and without risk to themselves or others, does not prevent the commission of a crime that affects people in their life, integrity or health, freedom or sexual freedom, will be punished with a prison sentence of six months to twenty-four months in other cases, unless the crime not prevented corresponds to an equal or lesser penalty, in which case the lower penalty will be imposed to that one”.

In addition, they add that point 2 adds that “the omission consisting of not going, being able to do so, to the authority or its agents, so that they prevent the commission of the aforementioned crimes, of whose imminent or current commission is punished. you have news".

“With this type of arbitrary behavior, they leave, in the face of the image that the citizen perceives of their security forces, that there is no coordination and that there could be a struggle of egos, when the civil guards only seek to serve the citizen with effectiveness and efficiency, and we are convinced that the local police also think so”, they add.

“This is about the security force that is closest to the event going to the event, because after all the citizen doesn't care who attends to them”, they conclude from AEGC.
