Traffic agents of the Civil Guard detected on September 23 a man driving a car despite having lost all the assigned points on his license. The intervention was carried out during a control on the LZ-40 road, at kilometer point 1, in Tías, when they stopped a car and identified its driver.
After carrying out the corresponding actions, they verified that said driver, a 43-year-old male, lacked a class B driving license, which enables him to drive said vehicle. He only had a Driving License issued in 1992 in force, but the mandatory points to drive had been withdrawn and he had not taken any recovery course.
Next, the agents proceeded to inform the driver of his investigation as the alleged perpetrator of a crime against road safety for driving a motor vehicle having lost the validity of the permit he currently possesses, due to the loss of all legally assigned points. Afterwards, after instructing the corresponding proceedings, they were transferred to the Arrecife duty court.
Prison sentence, fine or community service
The Civil Guard recalls that driving a motor vehicle having lost all legally assigned points is "a particularly serious infraction" that implies, beyond an administrative infraction, the commission of a criminal offense typified in article 384 of the Penal Code.
Chapter IV of the current Penal Code typifies crimes against road safety and establishes that anyone who drives a motor vehicle or moped in cases of loss of validity of the permit or license due to total loss of legally assigned points, will be punished with a prison sentence of three to six months or with a fine of twelve to twenty-four months or with community service from thirty-one to ninety days.
