The magistrate of the Criminal Chamber of the Supreme Court, Vicente Magro, has issued an order by which he orders to continue the case by the abbreviated procedure against the senator and former president of the Cabildo of Lanzarote, Pedro Manuel San Ginés Gutiérrez (Coalición Canaria) for alleged crimes of false testimony and/or accusation and false accusation.
In his order, he transfers the actions to the Public Prosecutor's Office and the private prosecution so that within 10 days they request the opening of oral trial formulating a written accusation or the dismissal of the case or, very exceptionally, the practice of complementary proceedings.
The magistrate has issued this order after the decision of the Criminal Chamber, of April 9, 2025, which annulled the order of free dismissal and definitive filing of the case, agreed by the instructor on April 17, 2024, and ordered its continuation. The Chamber upheld the appeals filed by the Public Prosecutor's Office and the private prosecution.
In the order of April 9, the Second Criminal Chamber of the Supreme Court defends that the agreed filing "is outlined as hasty" since it is "a case preceded by a previous instruction", which was "endorsed by the Provincial Court of Las Palmas".
The facts date back to Wednesday, November 11, 2009 at 10:30 p.m., when San Ginés appeared at the Civil Guard station in Costa Teguise to denounce Carlos Espino, Antonio González and José Manuel Páez for the contracts between the Tourist Centers and González's company, Climafrical.
The High Court states that although "there is no absolute link" between the complaint of Pedro San Ginés and the indictment of the businessman Antonio González "there is an undeniable evidentiary basis". In addition, it adds that these indications "are far from being labeled as extravagant or arbitrary" and that it even supported its "validation" when the order to open the oral trial was issued.
