The Deans Judges of Spain have shown their rejection of "the judicialization of politics" or lawfare after the agreement signed by the PSOE and Junts to achieve the investiture of Pedro Sánchez as president of the Government of Spain. Among them, the dean judge of the judicial district of Lanzarote has signed the statement.
The dean judges have joined the statement published by the Judicial Associations (Professional Association for the Magistracy, Judicial Association Francisco de Vitoria, Judges and Judges for Democracy and Independent Judicial Forum). With this, they have tried to show their disagreement with the creation of investigation commissions to detect cases of lawfare against pro-independence leaders.
"The text of the agreement reached contains explicit references to the possibility of developing investigation commissions in parliamentary headquarters in order to determine the presence of situations of judicialization of politics, with the consequences that, where appropriate, could give rise to liability actions or legislative modifications," they added.
In this sense, they have highlighted that these practices could involve the "parliamentary review of judicial procedures and decisions" which they understand as an "evident intrusion" into judicial independence and the "breakdown of the separation of powers."
Thus, the dean judges have defended that they should only "be subject only to the rule of law." In the line in which, "as they reveal some distrust in the functioning of the Judiciary, they are not acceptable."
To conclude, they have highlighted that the Judiciary in Spain is "independent" and that "it does not act subject to political pressures and has a system of jurisdictional guarantees that removes the risk that is pointed out."
