Case against Seprona sergeant and Leticia Padilla archived following veterinarian's complaint

The judge has agreed to the dismissal, finding no "justification for the perpetration of the crime" they were accused of. The complainant himself renounced the exercise of the accusation and requested the file of the proceedings.

The Court of Instruction Number 4 of Arrecife has agreed to the provisional dismissal and filing of the case opened against the sergeant of Seprona in Lanzarote, Gloria Moreno, and against the councilor of Ganemos in Arrecife, Leticia Padilla, who were denounced by the veterinarian of the municipal kennel of Arrecife for alleged crimes of slander and infidelity in the custody of documents.

In an order dated last Tuesday, July 10, Judge Ricardo Fiestras points out that "from the proceedings" since these proceedings were opened, "the perpetration of the crime that has given rise to the formation of the case is not duly justified." In addition, he recalls that the complainant himself submitted a document on June 25 "renouncing the exercise of the accusation and requesting the file of the proceedings."

The veterinarian, Javier López, presented that document five days after the sergeant and the councilor testified in court as investigated, considering that those statements dismantled the accusation that he himself had raised. Specifically, the veterinarian maintained in his complaint that councilor Leticia Padilla had accused him "repeatedly in local media of the alleged commission of a criminal act", making use of "various documents (registration books), which should be in the exclusive possession of the Civil Guard, as it referred to an administrative procedure in progress" regarding the management of the kennel.

 

Accused the sergeant of having "leaked" documents


In his complaint, the veterinarian stated that his right to honor had been violated by using "leaks of documents from an administrative file of the Civil Guard", and accused Gloria Moreno of these leaks, stating that she "could be directly responsible" for being the head of Seprona on the island at that time and "for the previous problems that existed between the non-commissioned officer and the complainant", since the latter "had been involved in several administrative and criminal proceedings at the request of Gloria." 

However, Moreno proved in her statement in court that these documents were sent by the Civil Guard to the City Council by means of an official letter on February 24, 2016, when the sergeant was on maternity leave, so there was neither "leak" nor could she be responsible. "There being no crime of infidelity in the custody of public documents on the part of Gloria Moreno, this party desists from the exercise of the private prosecution", concluded the veterinarian, in a document that has already led to the filing of the case by the investigating judge.
