The Socialist Party of Teguise demands that the Canary Coalition (CC), Popular Party (PP) and Vox government put an end once and for all to the "pathological secrecy" that it exercises with judicial sentences.
They make this request after learning of a new ruling of April 11, 2023, issued by the Contentious-Administrative Court number 3 of Las Palmas that condemns the City Council to pay 904,000 euros for the expropriation of land in Caleta de Famara.
"Despite having been dictated on April 11, in the prelude to the local elections, the judicial resolution had not been reported, despite the fact that the current mayor and candidate of the Canary Coalition at the time, Olivia Duque, was the councilor of urbanism”, says Marcos Bergaz, spokesperson for the PSOE.
From the socialist ranks they detail that the 904,000 euros correspond to 771,605 euros of principal amount, plus 132,395 euros of interest accrued due to the delay in setting the fair price, an amount to which must be added the interest generated by the delay in payment and the imposition of costs to the Consistory: “we fear that the final amount will exceed one million euros”, laments Bergaz.
Background
The plot in question, of 1,027 square meters, is classified as urban, consolidated, free space, annulled by the Rector Plan for Use and Management of the Natural Spaces of the Chinijo Archipelago of 2006 (PRUG), as well as by the Subsidiary Standards of Teguise of 2003 that classify it as ”green zone equipment”, rules that “revive”, that is, that become valid again after the annulment of the PRUG in 2016.
On this basis, the Judgment of April 11, 2023 of the Contentious-Administrative Court - released by the Socialist Group - declares the inactivity of the Teguise City Council and condemns it to pay the amount of 904,000 euros, plus interest for late payment and costs, since "all the causes of inadmissibility alleged by the Administration are rejected".
In this way, the Court condemns the payment of the fair price previously set by the Contentious-Administrative Chamber of the Superior Court of Justice of the Canary Islands, which by judicial resolution of July 11, 2018 - in another Judgment that the Teguise government, then presided over by Oswaldo Betancort (CC), did not report either - increased the amount to be paid from 632,457 euros to 771,605 euros definitive (including 5% of affection premium), with respect to that set by the Valuation Commission of the Canary Islands by agreement of November 16, 2016.
End to secrecy
For the PSOE, "now we understand something more about the refusal of CC, PP and Vox to communicate the judicial sentences, because unfortunately there were more 'surprises' in the Government's drawers, in the form of new millionaire convictions that harm the municipal coffers and that will have to be paid with the money of all the people of Teguise and Gracioseros", says Marcos Bergaz.
"And we say negative - recalls the spokesperson - because in September they voted against a socialist proposal for the sentences in which the City Council was a party to be made known to all political parties and citizens within 15 days of their notification."
The Socialist Group urges to end the practice of not communicating them, regardless of whether it is the sentence that increases the conviction for the Tahíche case by 1.2 million; be the return of more than 700,000 euros to a hotel developer for the construction tax; be the acquittal of a neighbor to whom the City Council was asking for nine months in prison for not demolishing a fence.
"For all these precedents, we again demand that the Government of CC, PP and Vox, for democratic health, transparency and good governance, put an end to the pathological secrecy they practice with judicial pronouncements", concludes Marcos Bergaz.
