The PSOE accuses Betancort of lying to prevent the Cabildo from recovering the costs charged by Calatayud

The spokesperson for the Socialist Group in the Cabildo of Lanzarote, Ariagona González, has expressed her rejection of "the lies with which Oswaldo Betancort intends to nullify the PSOE's motion for the Cabildo to recover the costs owned by INALSA and the Consortium, charged by Ignacio Calatayud."

"The PSOE is not lying because the judicial resolutions are clear: the costs belong to INALSA and there is no contract that allows the lawyer to charge for the incidents," said González, who insisted that "we are accused of lying by someone who has made lies and half-truths their hallmark."

González based her statements on two pronouncements by the Mercantile Court No. 1, which clearly state that, contrary to what Betancort maintains, "there is no contract whatsoever that authorizes Ignacio Calatayud to charge fees for the incidents of the INALSA bankruptcy proceeding and that, furthermore, the costs do not belong to the lawyer."

The socialist official recalled that Ignacio Calatayud filed a procedure against INALSA, trying to collect 82,606.9 euros for his participation in the bankruptcy incident 62/2012, after Loli Corujo refused to authorize him to collect costs from the other party.

This claim was rejected by the Mercantile Court No. 1, understanding that, as INALSA maintained, all the lawyer's actions in the Ordinary Bankruptcy 37/2009 are included within the budget of 151,600 euros approved by the Board of Directors of Inalsa, which has been paid, highlighting the absence of a contract or engagement letter that authorized the lawyer to collect the claimed amount.

Regarding the ownership of the costs, González pointed out that, after Calatayud's attempt to appear in the procedure by which INALSA demanded from the UTE EDAM JANUBIO the costs that the lawyer intended to charge, the aforementioned Court No. 1 of the Mercantile rejected that attempt to appear, stating verbatim: "Mr. Calatayud Prats is reminded that the procedural costs are a credit of the party, in this case Inalsa SA, not of the lawyer who presents the bill."

"Given the irrefutable force of these two pronouncements, it is not up to INALSA or the Cabildo to make any kind of interpretation and only the appropriate actions can be initiated to recover those costs," González stressed.

The socialist spokesperson concluded by warning that her group will continue to promote all necessary actions to achieve the reimbursement of the costs charged by Calatayud with the complicit tolerance of San Ginés.
