In a resolution signed on May 5, and received by Alternativa Ciudadana last Tuesday, the Provincial Prosecutor's Office of Las Palmas has notified that "it appears, indicatively, the possible existence of a corporate crime, prevarication or embezzlement of public funds" in the administration of the then public water company INALSA, noting that "those who held the positions of CEO of INALSA, Plácida Guerra, and Manager of the public company, Rafael Elorrieta, would be alleged perpetrators.
The document is issued in response to the complaint filed in 2013 by Alternativa Ciudadana 25 de mayo (member of the popular unity candidacy "Somos Lanzarote") which stated, before said Prosecutor's Office, a series of events that could constitute crimes of prevarication, influence peddling, corporate crimes, punishable insolvency and embezzlement of public funds, within the then public company.
After the analysis made by the public prosecutor of these accusations, he has resolved to send the complaint to the Arrecife Dean's Court so that the pertinent criminal process can be initiated.
In addition, the Prosecutor's Office urges the court to carry out a series of procedures, including "that a statement be taken from the accused", and from the Bankruptcy Administrators of Inalsa; that the annual accounts deposited by INALSA since 2006 in the Mercantile Registry be incorporated into the case; and that the Tax Agency report on all current accounts owned by INALSA and the Lanzarote Water Consortium.
The Prosecutor's Office document also urges the request for a series of minutes of sessions held by the Water Consortium, as well as the referral of external reports commissioned by the Consortium to Ignacio Calatayud Prats and Pedro Lasso Purriños
The Prosecutor also recommends "an examination of the accounting and current accounts owned by INALSA to identify monetary transfers between it and the Insular Water Consortium, from 2006 to the present"; "that it be verified whether the final destination of the amounts invested by INALSA in repairs effectively had that destination, through the control of invoices, work orders and personnel who executed them"; "that it be verified if there are unjustified items or expenses made by INALSA in the same period", as well as requiring the Consortium for the administrative acts that motivated the decreases and increases in the price of water in 2003-2004 and 2007, respectively.
