The businessman Juan Francisco Rosa could face 15 years in prison for almost a dozen crimes related to the construction and commissioning of the "macro-complex" Stratvs. That is the penalty requested for him by the Environmental Prosecutor's Office, which this Tuesday presented the indictment against 16 of the 17 people identified by Judge Silvia Muñoz in the order in which she concluded the investigation of the case on March 13.
In addition, the Prosecutor's Office also formulates an accusation against the company BTL Lanzarote, owner of the winery, which is claiming a fine of 108,000 euros, as well as the suspension of its activity for two years. This figure is added to the one that Juan Francisco Rosa would have to pay if convicted. Prosecutor Ignacio Stampa is asking for a fine of 267,000 euros for him, as well as the payment of some 350,000 euros in civil liability.
The architect Miguel Ángel Armas Matallana must respond "jointly and severally" for that amount. The prosecutor asks that between the two of them they compensate four of the "legitimate owners" of the land where Stratvs was built, who are the ones who have appeared as private prosecution in the case. In total, the Prosecutor's Office asks that they be compensated with 309,863 euros "for the value of the aliquot part corresponding to the legitimately usurped and built space, according to expert appraisal".
Rofe "stolen" and "destruction of the house"
In addition, Rosa and Armas should pay 14,810 euros each for the volume of rofe "stolen" during the excavation to build the winery and 943 euros "for the material destruction of the house" that existed on the farm, and that had ethnographic value. This figure represents one eighteenth of the estimated value of the damage, since the farm has 18 owners in total.
Among the crimes imputed to Rosa are those of usurpation of real estate and theft of goods of historical value, since he was not even the owner of the land where Stratvs was built, as well as crimes against land planning, historical heritage and the environment, fraud and influence peddling.
In addition, the Prosecutor's Office asks that "all the effects, products and income that have been obtained" with the construction and exploitation of Stratvs be confiscated, and that Juan Francisco Rosa be sentenced to six years of disqualification from exercising "any profession related to construction and real estate and/or urban development".
Ten years in prison for the architect
In the extensive indictment, made public by the State Attorney General's Office, the second highest penalty is requested for the architect Miguel Ángel Armas Matallana, who in turn was the owner of a part of the farm where Stratvs was built. For him, the prosecutor is asking for 10 years in prison, his disqualification as an architect for 4 years and a fine of 72,000 euros, for crimes of documentary falsification, crimes against land planning and the environment, a crime against historical heritage and another of usurpation.
The prosecutor also demands prison sentences and disqualification for 8 politicians and technicians from the Yaiza City Council and the Lanzarote Cabildo, and fines and disqualification for the other four defendants. In addition, he requests the demolition of the "Stratvs macro-complex", as well as the definitive closure of the activity. He also demands that all licenses and permits received, which lacked "any legal protection" and only "aimed to satisfy the interests of Juan Francisco Rosa Marrero, to the detriment of the rest of the citizens of the island", be declared null and void.
