The Government of the Canary Islands has sanctioned three tourist guides with 3,005 euros each for performing this function in Lanzarote without having the necessary qualification to do so. The affected parties, two women and one man, were located by tourism inspectors in Jameos del Agua and Montañas del Fuego, where they were working as guides but without a qualification, a fact that violates tourism legislation, according to the Official Gazette of the Canary Islands (BOC) published this Thursday.
In the first case, the sanctioning procedure was initiated on November 16 for events that occurred on April 6, 2011 against a tourist guide who did not have the necessary qualification from the Government of the Canary Islands. The inspectors identified her in Montañas del Fuego, where she was performing "the functions of a tourist guide" and verified that she did not have authorization or qualification as a guide.
In addition, the sanctioning procedure also states that a company hired this guide to carry out an excursion with English and two German users, despite the fact that it is "essential to have the corresponding qualification issued by the Public Administration of the Autonomous Community of the Canary Islands, a precept that has been breached", according to the BOC.
This infraction is considered "very serious", although in this case it has only been "serious" because the tourist guide did not have "intentionality". Therefore, the initially imposed sanction has been reduced and an amount of 3,005 euros has been agreed upon. Against this resolution, which does not put an end to the administrative process, an appeal may be filed with the President of the Government, Paulino Rivero, within a period of one month.
The next sanctioning procedure published by the BOC this Thursday was also initiated on November 16 against another tourist guide for events that occurred on April 5, 2011, when she was performing this function in Los Jameos del Agua without the mandatory qualification. In this case, the tourist guide had also been hired for an excursion with English and five German users. As with the other tourist guide, a sanction of 3,005 euros has been imposed on her.
Finally, the third sanctioning procedure was also initiated on November 16 against a tourist guide, who was located performing this work without the qualifying title in Montañas del Fuego, on June 1, 2011. "The existence of the culpable element in the commission of the proven infraction is deduced, in the form of negligence, with the administrative responsibility of the owner", is stated in the BOC. In this last case, the fine imposed is also 3,0005 euros.
