The mayor of Arrecife, Eva de Anta, has signed a decree this Friday to execute the sentence of the Superior Court of Justice of the Canary Islands that forced her to reinstate Asenet Padrón in her position as accidental secretary, who will resume her responsibilities next week. In addition, the Consistory will pay her compensation of 18,295.20 euros compared to the 182,388.58 euros claimed by the affected party.
The dismissal of Asenet Padrón occurred in January 2012 under the Mayoralty of Cándido Reguera and the Contentious-Administrative Court issued a ruling on September 5 annulling said dismissal "with the economic and any other legally inherent consequences of this pronouncement" and with condemnation of the City Council for court costs, a ruling that became final on November 24, 2017.
However, the Arrecife City Council did not then reinstate Asenet Padrón in her job and last October the Court issued a provision requiring the Consistory to "immediately" proceed to comply with the sentence, issue "the execution decree" agreeing to "the reinstatement in her job" of Asenet Padrón and pay her "the amounts owed to her as a consequence inherent to the sentence".
Arrecife appealed the provision ordering the execution of the sentence
The City Council then appealed said provision, although only with regard to the monetary amounts. However, it still did not reinstate Asenet Padrón as accidental secretary and said appeal was dismissed on December 11 by the Contentious-Administrative Court. The court again ordered the Consistory to comply with the sentence, stating that with respect to the economic and other consequences derived from the dismissal, "the appropriate separate piece must be opened" once Asenet Padrón is reinstated in her job "in case there is no agreement between the parties".
Thus, this Friday, the mayor of Arrecife has signed a decree by which she reinstates Asenet Padrón as accidental secretary with effect from December 10, thereby dismissing Pilar Machín, who has been performing this function in the Consistory. Likewise, Eva de Anta has resolved to pay Asenet Padrón "the amount of 18,2955.20 euros as economic consequences inherent to the pronouncement of the sentence", compared to the 182,388.58 euros claimed by Padrón.
The decree states that no appeal is possible against it "as it is issued in execution of a final judicial sentence, without prejudice to the actions that interested parties may promote before the Contentious-Administrative Court number 1 of Las Palmas de Gran Canaria".
