Pedro Quintana, buyer of several homes in the 21st century building, stood this Tuesday morning at the doors of the Arrecife Courts, to try to stop the auction of the property, which will take place on June 5. "I'm going to go every morning and if I don't find a solution before the 3rd, I'm going on a hunger strike", he threatened.
Quintana has assured that Banesto "wants to appropriate the building illegally", through an auction, which will be held in a notary's office in Arrecife. Previously, two auctions have already been held, which have been deserted. In addition, this affected party filed a complaint this Monday in the Guard Court against the notary who will carry out the auction, for an alleged crime of malfeasance.
"In my opinion, he is breaking the law, because there is an article in the Mortgage Regulations that says that if a criminal complaint for falsehood is admitted for processing, the notary is obliged to stop the auction. The complaint has been filed and the notary has not stopped the auction, even though he should have done so months ago", Pedro Quintana told La Voz. "A notary is a public official and when public officials issue resolutions contrary to the law, knowingly, they are supposedly committing a crime of malfeasance", he stated.
It should be remembered that more than 40 buyers reported the bank Banesto and also the promoter of the building, Masar Canarias, some time ago for several alleged crimes, including, "falsehood in mortgage title and improper bribery", according to Quintana. However, according to this affected party, the Courts "are asleep" and have not yet resolved this matter. "It seems that when one sues powerful people, banks, the measuring sticks of Justice are different", Quintana lamented.
More than 160 families are affected by this situation. "Banesto wants to keep the building. A building that this bank valued at 54 million euros and that now wants to award it for 33 million euros. And to us, who have contributed 11 million euros in total, they want to throw us out on the street like dirty water", he denounced.
"Some real hicks"
Pedro Quintana continues to demand a "serious negotiation" by Banesto. "There are many people who want to continue with the sale, who want that apartment. Not me anymore because I don't want to know anything, they have behaved like real hicks", said this affected party.
That is why Quintana has demanded that the promoter Masar Canarias return the money he deposited as a down payment to acquire several apartments in the 21st Century. He has even assured that he and another 20 buyers have "a final judgment" from the Superior Court of Justice of the Canary Islands (TSJC) that obliges the promoter to return this money "for breach of contract". "The amounts that they have to return to us exceed 3 million euros", he assured. However, to this day, they have not yet collected that money.
