The company Hernández Bello, awarded the garbage collection of Yaiza, has announced that it suspends the provision of the service from this Tuesday, February 12, a situation that it claims to have already communicated "in a timely manner" to the City Council. The company has made this decision after the City Council announced on Friday the awarding of the service through emergency and temporarily to Urbaser "due to the continuity in the breaches" of Hernández Bello. However, the entry of Urbaser is not scheduled until February 27, so the City Council stipulated that Hernández Bello would continue providing the service until the day before, according to the company itself.

In a statement, Hernández Bello expresses its surprise at the accusations of the City Council and states that the municipal officials have been "silencing" the "alleged breaches" and that, in addition, the City Council "has not satisfied any consideration" since last October.

In addition, Hernández Bello states that after the Advisory Council sided with the Yaiza City Council in its proposal to terminate the contract with the company and that the plenary session agreed on October 29 to the obligation to continue providing the service until the new award was carried out, it incorporated "immediately two additional collection vehicles, two drivers and four laborers" to the service.

 

"Firm conviction" of providing the service correctly


And "since that date - October 29, 2018. Hernández Bello, SL has not received any communication, complaint or notification from the City Council about possible deficiencies in the provision of the service; we reiterate, neither by the municipal technician responsible for the contract, nor by any other technician, official or municipal official has this company been transferred any reproach about the provision of what it has been developing in the collection of urban solid waste in the municipality", assures the company, which states that "of course, there has also been no news of any complaint from the residents of the municipality".

However, Hernández Bello states that "after the surprising communication of the plenary agreement last Friday and the accusations of possible breaches that are attributed in the report of the municipal technician on which it is based", it has "immediately adopted the appropriate measures aimed both at verifying the reality of the deficiencies attributed to it, as well as those of a legal nature necessary to purify the possible responsibilities to which its manager responsible for supervising the correct execution of the collection may be liable".

And it is that, Hernández Bello points out that this "has not transferred to the company any news of alleged incidents or damages in the provision of the service, being so that Hernández Bello has been acting at all times on the firm conviction of providing the service in strict accordance with the measures established by the City Council in its repeated plenary agreement of last October 29", to which effect it reiterates that it incorporated "the additional material and human resources mentioned above, with the consequent increase in the economic cost inherent to them, until now fully assumed by the company.

 

Non-payments of the City Council 


In this regard, Hernández Bello assures that "since last October, the City Council has not satisfied any consideration, without deigning to respond to the legal obligation to fix and pay the remuneration for the services contemplated in its decree establishing measures of last October 29, currently owing Hernández Bello the payment of the urban solid waste collection services corresponding to the months of November, December and January last, duly requested".

Thus, he points out that "the unsustainable nature of the situation generated by the aforementioned non-payments, together with the attitude of the municipal officials, silencing alleged breaches of which, without even an elementary hearing or contradiction procedure, Hernández Bello is surprisingly accused, intending to prolong the unsustainable situation until the assumption of the service by the new contractor", have motivated the decision to "suspend the provision of the service with effect from February 12, 2019, a circumstance that has already been duly communicated to the City Council".

Finally, the company states that it deeply regrets "the inconveniences and disruptions that the current situation, generated by causes completely beyond its control, is causing to residents, tourists, visitors, professionals, companies and entrepreneurs of the municipality", transmitting "to the citizens" its most "sincere apologies for such circumstance".
