The girlfriend of the deceased in Costa Teguise: “He grabbed him and threw him off the terrace”

The witness testified before the jury of the Court of Las Palmas that the accused threw his partner from the upper floor of the shopping center after a fight in the early morning of May 28, 2023.

The girlfriend of the man who died in 2023 after falling from the upper floor of the Teguise Playa Shopping Center stated this Monday before the Jury of the Audiencia de Las Palmas that she saw how the accused of his homicide "grabbed him and threw him" from the terrace after both had a fight.

In the second session of the trial with a Jury held at the Audiencia de Las Palmas, a Civil Guard agent who viewed the images recorded by a surveillance camera indicated that the defendant, Tobias C.K., "grabbed him and threw him like a sack of potatoes" on the morning of May 28, 2023.

The couple, who is also an employee of one of the commercial center's establishments, told the court that on that day they were having drinks with the victim, T.C.J., and another friend at a table in the "Saxo" pub and that the accused approached them despite her boyfriend "not wanting to" and began to utter shouts and insults.

Away from the place -she continued-, they ran into him again a little later, when they decided to go to a nearby restaurant to order a pizza and he "appeared" there again and "approached to attack", brandishing a champagne bottle from which he removed the cork, aiming, with the intention of hitting, his rival.

The latter approached him "trying to make him leave" but without success, both ending up in a fight in which they gradually approached the railing until, at a given moment, "he grabbed him and threw him", she added.

Her words have been corroborated by the manager of "Saxo", who stated that he was sitting not far away when he observed "the two fighting" and saw that, suddenly, "one grabbed the other and threw him", lifting him over the railing and throwing him into the void.

Which led him to fall to the floor below, located 3.30 meters away from the terrace floor where they were, as reported by a Civil Guard agent who came to investigate what happened.

Underlining that the protective fence he had to overcome to throw him out was solid, was about a meter high and was topped with a safety recess to keep the public away from the drop, which ruled out, in his opinion, that the fall could be accidental.

Furthermore, this agent has indicated that in the recordings from the security cameras of establishments in the area that were collected to find out what had happened, it could be verified that the aggressor, while shoving his rival, "in a second, grabs him and throws him, but as if he were a sack of potatoes".

Then falling to the ground, more than three meters below, where the doctor from the Servicio de Urgencias Canario ambulance who came to his aid found him "with a severe traumatic brain injury" and "unconscious, with agonal breathing" and signs that "he had to be assisted immediately".

Something she did, stabilizing his situation and taking him to the hospital, where, despite everything, he ended up dying shortly after, as he was in "a critical situation".

Meanwhile, his aggressor, who initially fled towards his car and left the area in it, ended up returning less than an hour later, being arrested by agents of the Policía Local who finally then placed him in the hands of the Guardia Civil.

The manager of the pub "Saxo", where the dispute originated, has stated that Tobias C.K. was not banned from entering but had to speak with him many times to tell him to "respect people".

The defendant "was very well known in the area", also indicated the deceased's partner, who said she had no dealings with him but that "she knew who he was", because he is someone who "likes to provoke people" and, because of this, "was forbidden from entering several bars".

After the testimony of these and other witnesses, the trial hearing, led by the Sección Sexta de la Audiencia Provincial, will continue this Tuesday in the Ciudad de la Justicia de Las Palmas de Gran Canaria, with statements from the experts who have technically analyzed the circumstances of the event.

The accused faces a sentence of twelve years in prison for the crime of homicide, which could be increased to 15 years, should the request made by the private prosecution exercised by the family of the deceased succeed.
