The approval of the General Urban Planning Plan of Arrecife is raising a new storm among the political groups of the City Council. For the moment, Alternativa Ciudadana, through a press conference, has stated its intention to vote against this approval, since they understand that it violates the regulations. "The General Urban Planning Plan cannot go ahead until the Basic Adaptation is approved, and to approve this, the substantial modifications must first be reflected in the document, put out for public consultation and sent to the COTMAC so that it definitively confirms the Basic Adaptation, which Arrecife does not have to this day", Andrés Barreto explained.
The current councilor of Alternativa Ciudadana argues this "illegality" based on the second transitional provision of the Law on Territorial Planning, since it states that the planning plans in force before the entry into force of the said law, which occurred in 2000, "will maintain their validity but must be fully adapted to the Consolidated Text before May 15, 2007". An adaptation that has not yet occurred in Arrecife and that, if not carried out, implies that "the approval of any planning without prior adaptation is null and void", argued Andrés Barreto.
Therefore, "Alternativa Ciudadana understands that Arrecife does not have a Basic Adaptation because the one that was considered good is illegal. Therefore, the progress of the General Planning Plan of Arrecife is null and void because there cannot be progress on a plan if the Basic Adaptation has not been made", Andrés Barreto assured. The councilor of Alternativa Ciudadana also explained that following this argument, the same could be applied to the Special Plan of the Port of Arrecife, because the Basic Adaptation was not in force, as is also the approval that was made of the declassification of protected housing, "so there is a legal gravity".
In this way, Alternativa Ciudadana has made a public call to all the opposition groups to be present in the plenary session in which the revision of the PGOU is debated and has requested "the immediate resignation of the mayor for lying to the citizens, since this plan only benefits six speculators". In addition, he has also warned that if the General Urban Planning Plan is carried out, we will "put it in the hands of the Anti-Corruption Prosecutor's Office and before the Contentious-Administrative Court".
