The second section of the Provincial Court of Las Palmas has sentenced Eulogio José Ramón Bernal to 10 years in prison for attempting to murder his partner at the home they shared in Tinajo, in 2009. Since then, the convicted man has remained in jail on remand.

His sentimental partner was hospitalized for 36 days, where she fortunately recovered from her injuries. This man has also been sentenced to compensate the victim with 8,470 euros for the injuries caused and for the sequelae that the woman has. Likewise, he will not be able to approach his ex-partner or his son within 500 meters.

According to the ruling, it is proven that this man took a hunting shotgun on May 27, 2009 and went to his sentimental partner, who at that time was in the living room of his house in Tinajo. "He took several cartridges, put two in the chamber and cocked it. Without prior notice, he fired a shot at the woman's abdomen, as a result of which she fell to the ground," the ruling states.

"The defendant left her sentimental partner bleeding on the floor" "and pointed the shotgun at her again." These events, according to the Provincial Court, were witnessed by the defendant's niece, who was in the house at the time. The couple's son, who was only six months old, was also at home. It was this niece who called the ambulance and the police.

The paramedics also had to attend to Eulogio José Ramón Bernal, after he "shot himself in the face with the weapon," according to the ruling. The woman, victim of this shot, had to be transferred to the Doctor José Molina Orosa Hospital, where she spent more than 36 days admitted. In addition, she was on sick leave for 120 days due to the injuries caused by the weapon.

Blood alcohol

Prior to these events, according to the ruling that has been made public this Friday, the defendant had been "in the Tinajo teleclub watching a football match, during which he drank a beer and a whiskey". The blood test that was done in the hospital after he shot his sentimental partner "reflected a blood ethanol result of 196 mg/dl, which slightly diminished his cognitive and volitional capacities."

Thus, the state of intoxication has only been taken into account as an "analogous mitigating factor" when imposing the sentence. On the other hand, the relationship with the victim has been accepted by the Court as an aggravating factor, so it has sentenced Eulogio José Ramón Bernal as the responsible perpetrator of a crime of attempted murder to a sentence of 10 years in prison.
