The illegal license that allowed the construction of the Los Fariones aparthotel will end up costing the City Council 2.3 million

The Colony Club complex sued the Council 39 years ago after losing the sea views, and the institution now celebrates that the payment will be much lower than what they claimed, which amounted to 36 million euros.

The Tías City Council will have to pay 2,394,658 euros to the community of owners of the Colony Club apartment complex, in Puerto del Carmen, for having granted in March 1983 the illegal construction license for the Aparthotel Los Fariones. This has been made public by the Council, which celebrates that the payment will be much lower than that claimed by the plaintiffs, which amounted to 36 million euros.

The final judgment of the Superior Court of Justice of the Canary Islands (TSJC) stipulates compensation of 490,425.52 euros for emerging damage and another compensation of 1,904,233.20 euros for loss of profits to the community of owners of Colony Club, having lost the sea views and no longer being on the beachfront after the construction of the aparthotel.

"After 39 years of litigation and although the City Council was facing a claim of 36 million, this conflict has finally been resolved with a judgment that places the total compensation at 2,394,658 euros, an amount that the Council will pay immediately," they point out from the institution.

The license for the Los Fariones aparthotel was granted in March 1983 and six years later it was annulled by the TSJC, among other things due to the easement of views, although the demolition never took place.

Now, the contentious-administrative chamber of the TSJC has definitively resolved this litigation, referring to the rights of third-party owners over the easement of views.
