Goodbye to calls to change the electricity contract

The Government is preparing a regulation that will prohibit the contracting of energy supplies by telephone, unless it is at the initiative of the client

The Government wants to put an end to telephone calls from companies that market energy and that tirelessly call individuals to contract new electricity, gas or other supply services.

This is reflected in the proposed General Supply and Contracting Regulations, which establish "the end of the possibility for marketers to advertise and contract for supply via telephone, except in cases where there is an express request from the consumer."

The National Commission on Markets and Competition (CNMC) had raised this measure in its latest report, which warned of "numerous complaints from consumers who receive misleading telephone calls from different marketers without the user's consent" to do so.

In 2022, the General Telecommunications Law was enacted, which already established the right of the end user not to receive unwanted calls with commercial communication objectives", that is, advertising, but did not prohibit the telephone contracting of services.

In its report, the CNMC warned that many energy marketers are not transparent either before or during contracting and engage in misleading practices."
