The Rubicón Palace hotel, built more than 15 years ago, has already obtained a new license from the Yaiza City Council to legalize its situation. The establishment thus becomes the second to overcome the legalization process initiated by the City Council, to comply with the sentences issued by the Superior Court of Justice of the Canary Islands, which annulled dozens of licenses.

In a Governing Board held last January, the City Council already concluded that this hotel complied with the new General Plan of the municipality, so a new permit could be granted. However, it was not granted at that time, since it still had to fulfill some procedures, such as constituting a guarantee that would guarantee the completion of the urbanization works that corresponded to it. As the mayor, Gladys Acuña, explained to La Voz this Wednesday, there was also "missing the tourist authorization from the Cabildo", which "had been granted but was not correct", which has delayed the granting of the municipal license.

Finally, in the new Board held this Wednesday, the City Council has already granted the new permit, allowing the situation of this hotel, located in the Montaña Roja Partial Plan, to be regularized. "It has already paid the fees and capital gains", the mayor specified, who stressed that in this case, the constructed area does not exceed the buildability allowed by the Plan on that plot, unlike what happens with other hotels that have been denied the license.

 

Three cannot be legalized and two have been legalized


Along with the Rubicón Palace, the Costa Calero hotel has now been legalized, which was the first to receive a new license, last May. In the case of that establishment, the constructed area was greater than allowed, but the "incentive" of buildability contemplated in the new plan could be applied, allowing an increase in the constructed area if it is destined for common areas.

For their part, three other hotels have not passed this legalization process, since they not only failed to comply with the regulations in force when they were built, but also fail to comply with the new General Plan of Yaiza. Thus, the City Council has already denied the license to Son Bou, Princesa Yaiza and Papagayo Arena, ordering their owners to present a project for total or partial demolition in order to legalize their situation.

However, the legalization projects presented by the promoters in recent months have also been rejected by the City Council, since they did not comply with the municipal mandate. In the case of Princesa Yaiza, the property has presented an amendment to the project, which is now being studied by the City Council. As for Son Bou and Papagayo Arena, the City Council has already addressed the Superior Court of Justice of the Canary Islands, reporting that it has denied the license. "We are waiting for a response from the Court", says the mayor, who stresses that those two files are already finished and that now "the judicial opinion will be attended to".
