The arguments of the developer Algol for not facing the payment of the fees of the Union for the Conservation of Costa Teguise have been dismissed again by the courts, who have sided with the conservative body of the tourist and residential town of the municipality of Teguise for the second time.
The Provincial Court of Las Palmas has upheld the appeal filed by the UCCT against a ruling issued by the court of first instance number 5 of Arrecife in December 2007, and condemns the entity Algol Desarrollo Inmobiliario S.L to pay the amount of 404,814, 36 euros plus interest of 1'5 percent per month from the date of maturity of payment of the respective fees. In addition, the Court also obliges Algol to pay the costs of the first instance.
This is the second victory of the UCCT against ALGOL real estate development, since the Provincial Court of Las Palmas also condemned the developer on July 14, 2008 to the payment of 172,602 euros and the payment of interest and costs of the process.
For the UCCT, "not only is this body in luck for having won the two previous judicial proceedings, but also, according to the agreement carried out with the City Council of Teguise, the fees due and not paid by the associates will be managed directly by the Vía de Apremio, according to the statutes of the entity".
