The Socialist Party has received the latest ruling of the Superior Court of Justice with "satisfaction" because they interpret that the ruling "corroborates the contents of the legal report of the Cabildo", on alleged "irregularities" in the granting of licenses in the municipalities of Yaiza and Teguise, which motivated the complaint filed by the then Minister of Territorial Policy, Carlos Espino, in the month of November. Now, the mayor of the southern municipality, José Francisco Reyes, as well as Juan Pedro Hernández, will have to answer for his urban planning management before the criminal justice system, and will testify next Tuesday as charged with "alleged crimes of malfeasance, influence peddling, bribery and money laundering".
According to the socialists, the decision of the TSJC questions for the first time the legality of granting licenses "by silence" and sets doctrine in this regard. In this case, the ruling that dismisses and rejects the appeal of the City Council of Yaiza makes firm the one that annulled the license with which the tourist complex of Las Coloradas was built during the island moratorium, so "it is also foreseeable that the doctrine established by the Chamber on the licenses that the mayor of Yaiza granted through certifications of positive silence will also cause the annulment of the construction permits of other three tourist complexes by this system", argue the PSOE.
At this moment, a total of 11 judicial proceedings filed by the Cabildo against the City Council of Yaiza and another four lawsuits against the City Council of Teguise are completely finalized and pending only judgment. It is foreseeable, therefore, that over the next few months rulings will be announced that could annul illegally granted licenses to more than 10,000 tourist places on the island.
Annuls the construction license
The TSJC ruling constitutes the sixth consecutive ruling that annuls urban planning permits granted by the mayor of Yaiza during the island tourist moratorium, according to recalls the PSOE. The Canarian High Court highlights that José Francisco Reyes allowed the works of the tourist complex to begin, despite the fact that "it was impossible because he had all the reports against it" both "those of the Cabildo and that of his own municipal technician, in which it literally says that it does not comply with the municipal urban planning provisions". The municipal secretary had also warned that the file lacked the reports from Housing and compatibility with the PIOT.
According to the judicial decision, the silence that protected the granting of the license was "totally negative, as has always been collected in our regional regulations". The magistrates also ask themselves "why the City Council of Yaiza decides to issue the certification of obtaining the license by positive silence, when everything led to negative silence".
