The Arrecife City Council has managed to get the Public Service to authorize the reinstatement as accidental auditor of the worker whose appointment had been declared null. In a resolution issued this Thursday, the Government of the Canary Islands considers the "defect detected" in the appointment of Sandra Leticia Estellé to be corrected and allows her to continue in the Intervention until the nationally qualified person appointed for the position is incorporated.
Sandra Leticia Estellé was appointed accidental auditor of Arrecife in March, after Elena Gómez ceased in the position after obtaining a place in the Tías City Council. However, the Public Service declared her appointment null a month later for not being nationally qualified and because the City Council can only propose, but not appoint. Thus, it urged the institution to formulate "a proposal for accidental appointment" of an official "with adequate technical preparation".
In addition, as the Minister of the Presidency, Justice and Equality of the Government of the Canary Islands stated this Wednesday on Radio Lanzarote-Onda Cero, the new regulations that regulate the legal regime of local administration officials and that came into force in March, say that "an official who is already in the house" cannot be appointed.
Subsequently, on May 11, the Public Service appointed the nationally qualified Martina Manteiga to perform "on a provisional basis" the job of Intervention, after she requested it, but she was given a period of one month for her incorporation. Thus, in the absence of an auditor until the new official is incorporated, the City Council again addressed the Public Service on May 18 to request that the appointment of Sandra Leticia Estellé as accidental auditor be validated.
"Organizational reasons and shortage of human resources"
The Mayoral resolution indicated that "the municipal intention was to formulate a proposal for appointment to the General Directorate of Public Service, in favor of Mrs. Sandra Leticia Estellé Padrón, in order to guarantee the continuity of the functions of the Intervention post and not alter the functioning of the Corporation, which is why a resolution of error correction was issued".
The mayoress of Arrecife, Eva de Anta, argued that "the public functions assigned to the Intervention post are essential and cannot be neglected", pointing out that "there are organizational reasons and a shortage of human resources in the Corporation with the necessary professional profiles and categories, making it impossible to appoint a career official from subgroup A1".
The appointment occurred before the new regulations came into force
In addition, De Anta added that "Sandra Leticia Estellé Padrón has the technical training and experience for the exercise of the functions of Intervention" and pointed out that "as the municipal proposal was made prior to the entry into force" of the new regulations "and this rule does not incorporate a transitional regime, the accidental appointment of said official would proceed until Martina Manteiga is incorporated".
Now, and after the Minister of the Presidency, Justice and Equality of the Government of the Canary Islands, José Miguel Barragán, stated this Thursday that the regional Executive was "collaborating" with the City Council to find "a formula" that would allow the reinstatement of Sandra Leticia Estellé, the Public Service has accepted the arguments put forward by the Arrecife Consistory and has validated the appointment of this worker so that she can continue to perform Intervention tasks until Martina Manteiga is incorporated.
