The Provincial Court has suspended the trial that was to be held this Tuesday in the Courts of Arrecife against a man accused of breaking several teeth to a woman in a bar in Costa Teguise. The private prosecution has presented at the last minute an expert report of the injuries of the affected party and the defense of the accused and the lawyer of an insurance company have requested the suspension of the trial, which has been set for July 7 in Las Palmas de Gran Canaria.

The events that were to be judged this Tuesday occurred on January 10, 2010 at 4:00 a.m. The Prosecutor's Office was asking for the accused, Luis Ángel E.C., four years and six months in prison for a crime of injury. The defense requested free acquittal.

According to the Prosecutor's Office's indictment, the accused had an argument with a third person inside the "Anaiak" premises, located in the Nautical Shopping Center, on Islas Canarias Avenue in Costa Teguise. For that reason, he was expelled from the bar.

Faced with this situation, the accused "took a chair from the terrace and, with the intention of causing damage to the physical integrity of the people who were inside the aforementioned establishment or, at least, accepting the possibility that this would happen, he brutally threw it inside the pub." The chair reached a woman and hit her "hard in the face", causing her facial trauma.

The blow also caused the "complete avulsion" of three teeth, that is, their removal, the fracture of another three teeth and the "total" breakage of two more pieces. In addition to first medical assistance, the affected party required dental medical treatment, which consisted of a large reconstruction of eleven pieces, two implants and a provisional prosthesis, among others.

"A very important aesthetic damage"


It took 30 days for her wounds to heal and she was incapacitated during all this time for "her usual occupations", according to the Public Ministry's writing. As a result, this woman lost five teeth and suffered a coronary fracture of another three pieces, which were repaired by conservative dentistry techniques "with a very important aesthetic damage".

According to the Prosecutor's Office, at the time of the commission of the events, the owner of the pub, with a civil liability insurance arranged in Mapfre, "infringed the provisions of article 1 of Decree 193/1998 of October 22", by which the opening and closing hours of certain public activities and shows were approved. The closing time set was 2:00 a.m.

In addition to the four years and six months in prison for the accused, the Prosecutor's Office also asks that he compensate the affected party with the amount of 1,800 euros for the injuries suffered, and with 17,215 euros for the consequences, with direct civil liability of the insurance company and subsidiary of the owner of the premises. The trial will have to be held on July 7 in Las Palmas de Gran Canaria, after the oral hearing that was to take place this Tuesday in the Courts of Arrecife was suspended.
