Investigated for a crime against land management for an illegal construction in Ye

The works do not have a license and are not compatible with the current urban planning regulations

Agents of the Nature Protection Service (Seprona) of the Civil Guard in Lanzarote investigated a man on June 29 as the alleged perpetrator of a crime against land management and urban planning, for carrying out works on land classified as rustic in the municipality of Haría.

As reported by the Benemérita, these works were carried out continuously from 2016 to 2020 on a tool shed, considerably increasing its volume and transforming it into a home without obtaining the corresponding license.

As a result of a complaint received in December 2019, the Seprona Detachment in Lanzarote initiated an investigation for a possible crime against land management in the town of Ye, where an illegal construction was carried out on rustic land without a license or enabling titles.

The Seprona carried out the corresponding technical on-site inspection, verifying the extent of the work in question and requesting the promoter to provide the necessary permits to prove the legality of the works.

However, the person in question did not provide them to Seprona, and it was also verified, through the municipal corporation, that the location of the works is classified as rustic land with the categorization of Rustic Land for Environmental Protection, which corresponds to the category of Land of Environmental Values, so they cannot be legalized either.


Penalties of up to four years in prison

Given these facts, which constitute a crime under Article 319 of the Penal Code, where penalties of up to 4 years in prison are established, Seprona investigated the man in question as the alleged perpetrator of the aforementioned crime against land management.

The investigated party, along with the police proceedings carried out, were made available to the corresponding Duty Court of Arrecife, awaiting a date to be set for the oral trial later on.
