The Court of Instruction Number 4 of Arrecife has condemned the owner of a bar in Playa Honda for a minor crime of injury for assaulting a client, after he told him that he did not like the sandwich he had eaten.
The sentence considers it proven that "on April 30, 2021, at approximately 5:25 p.m., after a previous discussion, J.P. pushed and threw J.J.L. to the ground, who was sitting on a curb, talking on the phone." "As a result of the aggression," the ruling adds, "the complainant suffered injuries that took 5 non-disabling days to heal."
Regarding that previous discussion, the victim explained to La Voz that "he entered a bar to eat a roast leg sandwich" and that when ordering it, he asked the waitress if "it was homemade or from a supermarket", to which she replied that "they made it." However, he points out that when they served him the sandwich, he realized that "it was not homemade" and told the waitress that this "was not what he had ordered." According to his account, he then finished eating the sandwich and "went to the bar next door."
When he was at the door of that bar, "smoking a cigarette and making a video call with his daughter," the owner of the other establishment stood in front of him and began to "insult him", and then "give him a push" that caused him to fall "into the pit of a palm tree." JJ assured that "once on the ground", the man began to kick and punch him.
The ruling considers this aggression proven and imposes the payment of a fine of 120 euros, which in case of non-payment due to insolvency, is computed to one day of deprivation of liberty for every two unpaid daily installments. In addition, the owner of the bar is ordered to compensate the complainant with the amount of 150 euros.
