The Provincial Court has dismissed the appeal filed by the defense of José Francisco Reyes against the order of November 12, 2007 of the Investigating Court number 2 of Arrecife that agreed to the investigation by this police force of the assets of both mayors. The defense argued that the Drugs and Organized Crime Unit (Udyco) should not intervene because it was not competent in this matter, as it did not involve crimes against public health or an organized group to commit crimes.
However, the resolution, notified on October 13, states that the Udyco is "relevant to the investigation and is also a consequence of the proceedings carried out, as stated by the appellant himself when alleging that certificates from the Land Registry and the Commercial Registry in relation to the assets of the accused (referring to José Francisco Reyes) are on record in the case".
This resolution also states that the judge may entrust these proceedings to specialized Judicial Police Units "as they involve crimes that entail an arduous and complex investigation".
It should be remembered that a judicial procedure is still open in Court number 2 of Arrecife as a result of the complaint filed by the councilor of the Cabildo for the PSOE, Carlos Espino, for the granting of illegal licenses to hotels in Playa Blanca and Teguise. The courts have annulled more than 25 licenses. The Police are investigating the alleged commission of the crimes of bribery, prevarication, embezzlement of public funds, influence peddling and money laundering.
