The PP denounces that the auditor's report is "devastating" against the Puerto del Carmen golf course

They disagree with the economic amount to be paid to the owners of the land, 4.5 euros per square meter, and with the absence of 10% of the residential land for the City Council The popular party accuses the mayor of dismissing the auditor because he objects to his interests

The Popular Group of Tías denounced this Friday various irregularities in the recent approval of the specifications of administrative clauses for the sale by auction of the assets that correspond to the Tías City Council, the result of the average use of the Partial Plan of the Puerto del Carmen Golf Course.

The popular party criticized that since November 2003 they have been opposing the project, since then the government group began the expropriations of the land accepting a very low offer from the Compensation Board of the Golf Course. Specifically, only 4.50 euros for each square meter of the affected land, "and belonging to many humble neighbors with few economic resources", explained the councilors.

A "derisory" price

"The starting price for this auction is derisory and the auditor's report is negative to the sale by auction of 2,500,000 euros (420 million pesetas) for an area of 87,000 m², which seriously harms municipal interests."

The spokesperson for the PP in Tías, Francisco José Hernández, announced that "we have put this matter in the hands of our legal advisors, so that they can check if there are indications of illegality, and we even do not rule out going to the Prosecutor's Office." In this sense, the execution of the surface of the field itself is around 150 million euros, so the successful bidder must have at least 570 million of the old pesetas to take over the land.

A "negative" report

The Popular Group, through its councilor Ramón Melián, criticized said sale arguing the existence of a negative report from the Intervention, which is "clear and resounding", and which was revealed during the plenary session last Tuesday.

The auditor's report

It was in the seventh point in which the popular party denounced before the Plenary a report from the auditor that in the celebration of the Information Commission, a few days before the plenary session, "was not in the file." According to the PP, in said report the auditor issues a "devastating" report on the sale, highlighting that he is informed one day before the Information Commission of the realization of the mandatory report required by law, "not complying with the established deadlines to issue reports." The popular party also criticized that in the City Council there is no Exploitation Registry, as required by decree 1/2000 of May 8 of the Consolidated Text of the Laws of Territorial Planning of the Canary Islands.

In his report, the auditor highlights that prior to said sale, a justification report with the cause of the sale, physical and legal purification of the property to be sold and its clear identification, with the contribution of the registration in the Property Registry, should be included in the file, "and that they are not included in the file."

Similarly, the report indicates that in one of the four uses in which the compensation project is divided -hotel plot, commercial plot, golf course plot and residential plot, 10% of the residential use does not appear, "by the way, the plot with the highest economic value", thus failing to comply with the current legality of assigning a linear 10% for each of the uses.

In the document, the auditor also highlights that it is not revealed that the asset object of sale is not necessary for general use, and that the sale has not been separated by lots, which limits the concurrence to the auction, in addition to not having been published in the Official State Gazette (BOE), "failing to comply with the Local Regime."

Dismissal of the auditor

José Francisco Hernández accused the mayor, José Juan Cruz Saavedra, of wanting to dismiss the current auditor of the City Council to achieve the approval of a series of actions that he sees as not very viable. "At the end of August he will have been serving the City Council for 18 months, but the mayor does not want him to continue because he has objected, through negative reports, to matters to be approved, because certain essential requirements have not been met," Hernández explained.

According to the PP, each and every one of the formations in the Consistory are "very satisfied with the work carried out by this professional." Even several workers have congratulated his work and have addressed the mayor imploring his continuity at the head of the Intervention.

The General Plan, in the BOC

The Official Gazette of the Canary Islands (BOC) included in its edition this Friday the announcement of the final approval of the Full Adaptation of the General Plan of Tías. With its publication in the BOC, the General Plan culminates the administrative route that began in March 1985.

"The mayor is going to act in the same way in which he has acted with the Partial Plan of the Puerto del Carmen Golf Course with the 26 action units and 7 partial plans -5 in Tías, one in Mácher and another in Puerto del Carmen"- that must be carried out from now on after the approval of the General Plan of Tías", considers the PP.

In the words of the popular councilors, the current auditor is "transparent with all the parties of the City Council" and "that is what makes the mayor and the government group uncomfortable, who need another auditor to write in positive and without objections as many reports as they want, and who also does not inform the opposition", they concluded.

Island Congress

On the other hand, questioned about the current division suffered by the PP after the last institutional crisis on the Island, José Francisco Hernández, who is part of the management committee that has taken over the party, confirmed on behalf of the local committees of the party in Lanzarote that they will try to "convince José Manuel Soria -president of the PP in the Canary Islands- so that, at the latest, in October the date of the celebration of an upcoming Island Congress is known. "We need to renew and identify ourselves with a new directive", he added.
