The Sixth Section of the Provincial Court of Las Palmas will try next April 27 in Lanzarote a defendant for sexually assaulting a 13-year-old girl in Arrecife.
The events date back to the year 2023, when the accused met the minor at her uncle's house. The alleged aggressor was living temporarily at this address and took advantage on one of the occasions to sexually assault the minor by touching her buttocks area over her clothes.
The Prosecutor's Office has classified these acts as a sexual offense against a minor under 16 years of age, despite the fact that the Only Yes Is Yes Law of 2022 establishes that these types of sexual offenses are aggressions.
Therefore, the Public Prosecutor's Office requests for the accused six years of prison and special disqualification for the exercise of the right to passive suffrage during the sentence, as well as special disqualification for any profession or trade, whether remunerated or not, that involves regular and direct contact with minors for five years after the sentence.
In addition, he also requests the prohibition of approaching within 500 meters of the victim, her relatives, her home, place of study or work or any other where she may be for a period of five years longer than the prison sentence imposed, which will extend for another five years after serving the prison sentence.
Likewise, the Prosecutor's Office requests for the accused supervised release for ten years after leaving prison and the obligation to attend sex education programs.
The defendant shall bear the court costs and shall compensate the victim with €6,000 for moral damages.
