The Contentious-Administrative Chamber of the Superior Court of Justice of the Canary Islands (TSJC) has initiated this Monday the procedure corresponding to the request of the Government of the Canary Islands that on the islands with alert level 3 or 4, mobility can be limited between 00.30 and 06.00 hours, thus avoiding crowds at that time.
As established by Law, the Public Prosecutor's Office has been transferred to report and from 09.00 hours on Monday the period of 3 calendar days has begun for the Contentious-Administrative Chamber of the TSJC to respond to the request of the Executive.
In the event that the jurisdictional body refuses to approve the requested measures, the Government of the Canary Islands may appeal to the Supreme Court, which has 5 days to resolve.
Last Saturday, the President of the Canary Islands, Ángel Víctor Torres, announced that this request had already been submitted to the TSJC with scientific and legal arguments, in addition to the data from the municipalities with the greatest impact of infections.
Ángel Víctor Torres hopes that the decision of the TSJC will be favorable because the 'curfew' is "an instrument that undoubtedly helps to stop infections and, since it occurs during the night, there is no economic impact"
Torres emphasized that the limitation of mobility at night avoids crowds and concentrations of young people, especially at a time when most of the infections are occurring in the population under 30 years of age, which is not vaccinated
