The Second Section of the Provincial Court of Las Palmas has sentenced the former mayor of Arrecife Isabel Déniz (2000-2007) and the former secretary of the capital of Lanzarote Felipe Fernández Camero to more than ten years in prison each for the Jable case, the last piece to be judged within the framework of the Unión case.
In addition, the sentence of the Chamber, of which Magistrate Mónica Herrera was the rapporteur, has imposed a sentence of five years in prison on the then head of the Technical Office of the Arrecife City Council Rafael Arrocha and two and a half years on the former leader of the Independent Party of Lanzarote (PIL) Dimas Martín. An appeal in cassation may be filed against the judgment before the Supreme Court within a period of five days.
Operation Jable was named as such by the Central Operative Unit (UCO) and named as the most complex judicial case in the Canary Islands due to its extension and volume. This plot arises as a result of the irregularities found in the tenders to the company Urbaser for the garbage contract of the City Council of the capital during the mandate of Déniz and the award to Fomento Construcción y Contratas (FCC) of the construction of the Argana Alta pavilion.
Isabel Déniz
The Chamber has sentenced María Isabel Déniz to a penalty of ten and a half years in prison, a fine of 282,000 euros and disqualification from holding public office for 42 years, considering her the author of the five crimes (bribery, abuse of power and fraud, among others) attributed to her by the Public Prosecutor.
In particular, the former mayor of Arrecife has been sentenced to one and a half years in prison for a crime of fraud against the administration, with the accessory special disqualification to exercise the right to passive suffrage and special disqualification from employment or public office for six years; as well as another six years of disqualification from holding any public office for a continued crime of administrative prevarication; five years in prison and a fine of 282,000 euros for the crime of bribery, as well as 12 more years of disqualification; another year and a half in prison for the crime of fraud against the administration and six years of disqualification; two and a half years in prison for another crime of bribery, as well as special disqualification for another six years for the crime of administrative prevarication.
Felipe Fernández Camero
The Provincial Court has also sentenced Felipe Fernández Camero, the only one who remains active, to a total of ten years and three months in prison for the crimes of fraud, bribery, disclosure of secrets and infidelity in the custody of public documents. Thus, he has also been imposed an economic sanction of 32,837.76 euros and 30 years of disqualification from holding any public office.
Specifically, the former secretary of the Arrecife City Council has been sentenced to one year and six months in prison, disqualification from the right to passive suffrage during the term of the sentence and disqualification from holding any employment or public office for eight years for a crime of fraud against the administration; two years and six months for a crime of bribery, as well as a fine of 32,837.76 euros and disqualification for another ten years; plus one year and three months in prison and four years of special disqualification from public office for disclosure of secrets with serious damage to the public cause; as well as three years and six months in prison for a crime of falsehood committed by a public official and disqualification of four years; and a year and six months in prison, a fine of ten months with a daily fee of 25 euros and disqualification for four more years for a crime of infidelity in the custody of documents.
In addition, 14,000 euros delivered by those responsible for Urbaser Manuel Andrés Martínez, Santiago Alonso Herreros and Jacinto Álvarez de la Fuente to Felipe Fernández Camero will be seized.
Dimas Martín
In this line, the historic former leader of the Independent Party of Lanzarote (PIL) Dimas Martín has been sentenced to two and a half years in prison, a fine of 72,000 euros and disqualification for 12 years for the crimes of fraud against the administration and bribery. For Dimas Martín, the attenuating circumstances of confession, undue delays and the aggravating circumstance of recidivism in the crime of bribery have occurred.
Regarding Dimas Martín, already in prison for other judicial cases, six months of prison have been imposed for the crime of fraud against the administration, as well as special disqualification from employment or public office for six years, as well as two years less one day in prison, a fine of 72,000 euros and disqualification for another six years for a crime of bribery.
Rafael Arrocha
While Rafael Arrocha, then head of the Technical Office of the Arrecife City Council, has been sentenced to five years in prison, as well as a fine of 100,000 euros and disqualification from holding public office for 25 years and eight months.
Of these, six months in prison, special disqualification for the right to passive suffrage, as well as disqualification from holding employment or public office for five years for the crime of fraud; as well as special disqualification for five years for the crime of administrative prevarication, a sentence of two years in prison, a fine of 100,000 euros and disqualification from holding public office for six years for a continued crime of bribery; six months in prison, disqualification from holding public office for two years for a crime of disclosure of secrets with serious damage to the public cause; as well as a sentence of one year and a half in prison, a daily fine of six euros for five months and special disqualification from public employment for one year and eight months for the crime of falsehood committed by a public official; another six months in prison for a crime of fraud against the administration and six years of disqualification from public office; and to conclude, another six years of disqualification for the crime of administrative prevarication.
The rest of the defendants
Among the rest of the defendants, the former director of Urbaser Manuel Andrés Martínez, who had confessed the facts, has been sentenced by the Second Section of the Provincial Court after reaching an agreement to three months in prison for the crime of fraud against the administration; disqualification from holding public office for one year, as well as nine months in prison and a fine of 110,000 euros for the continued crime of bribery; as well as three months in prison for a crime of use or exploitation of privileged information; and nine months in prison for a crime of falsehood committed by a public official, as well as a fine of four months with a daily fee of eight months, with disqualification from public office for one year and the payment of 4/7 parts of the procedural costs.
Thus, another former director of Urbaser Santiago Alonso has been sentenced to three months in prison, special disqualification to exercise the right to passive suffrage for the time of the sentence and special disqualification from employment or public office for one year for a crime of fraud against the administration; another nine months in prison and a fine of 110,000 euros for a continued crime of bribery: thus, for the crime of use or exploitation of privileged information with serious damage to the public cause three months in prison; and to conclude, nine months in prison, disqualification for passive suffrage during the time of the sentence and disqualification from employment or public office for one year for the crime of falsehood committed by a public official.
For the head of the construction company FCC Francisco Martínez Llerandi, a year in prison has been imposed for the crimes of fraud against the administration and the continued crime of bribery, as well as a year of disqualification from holding any public office, a fine of 55,000 euros and the payment of the costs of 2/7 parts. While the other head of the construction company FCC Enrique José Hernández, has been sentenced to one year and three months in prison, disqualification for passive suffrage for the time of the sentence, a fine of 16,674.11 euros and special disqualification from employment or public office.
Meanwhile, the manager of Urbaser in Lanzarote, Jacinto Álvarez, has been sentenced to one year and nine months in prison. Specifically, one month and fifteen days in prison for a crime of fraud against the administration, one year of special disqualification to hold any public office, as well as one year in prison for the continued crime of bribery and a fine of 110,000 euros, as well as three months in prison for the crime of exploitation of privileged information; to this is added four months and fifteen days in prison for the crime of falsehood committed by a public official, disqualification to hold public office for three months, the payment of 4/7 parts of the costs and special disqualification to hold public office in three months.
Meanwhile, José Domingo Abreut, as responsible for lucrative title, must pay 141,000 euros.
The Chamber has also acquitted Enrique Astorga González, Manuel Jesús Isidro Espínola, Julio Pedro Romero, Daniel Hernández Caraballo, Rafael Antonio Corujo, Miguel Ángel Leal and Stephan Jean Balverde of all the crimes of which they had been accused and has declared the costs ex officio. In addition, the Provincial Court has also acquitted Elena Martín, Urbaser S.A. and F.C.C. Construcción S.A. who appeared as participants for lucrative title.
