The Central Court of Administrative Litigation number 5 has annulled the sentence that canceled the registration of Nueva Canarias in the registry of political parties of the Ministry of the Interior, for having carried out that file without ensuring that the party was notified, so that it could defend itself as it deemed appropriate.
"Considering the notifications made in this process to be defective and there being no record of any efforts to ascertain the address of the defendant (Nueva Canarias), it is appropriate to declare the nullity of the present procedure from the notification of the admission decree," the Court's resolution states.
The order thus gives Nueva Canarias the reason against the procedure in which another judge considered it to be a party "without activity" for not having communicated in time the update of its statutes, despite having representatives in Congress, the Parliament of the Canary Islands, the Cabildo of Gran Canaria and numerous city councils.
Specifically, the request for annulment of the sentence filed by the party itself, which had to register provisionally as NC-Bloque Canarista, to continue operating, and by several affiliates such as the mayor of Tacoronte, Daniel Díaz, and the Arrecife councilor Armando Santana, is granted.
In a statement, Nueva Canarias explains that "with that order, the case goes back to the moment in which the Ministry of the Interior's lawsuit for which the political formation was canceled from the aforementioned registry is admitted for processing."
This decision allows the political organization to appear and defend itself in said procedure to prove that the statutes are adapted to the new Organic Law 6/2022 on Political Parties, since in the original procedure the actions were never notified to it.
The order made public this Wednesday, in the opinion of Nueva Canarias, "expresses itself forcefully and clarifyingly about the injustice" committed with its political formation by having its registry extinguished "without even knowing of the existence of a judicial procedure and, consequently, without having had the opportunity to defend itself."
From the leadership of Nueva Canarias it is recalled that it was announced that "all pertinent actions would be taken in the defense of our rights." Although the political adversaries "have tried to use this nonsense to get us out of politics, common sense, prudence and the rule of law have prevailed," NC adds.
This judicial resolution "is also preceded by separate writings from the Public Prosecutor's Office and the State Attorney's Office, dated October 5 and 23, respectively; in which they adhered to the incident of nullity presented by Nueva Canarias and its militants," adds the Canarian formation.
