The Government of the Canary Islands has ordered the referral of the file of the Special Plan for the Protected Landscape of La Geria to the Second Section of the Superior Court of Justice of the Canary Islands (TSJC), following an appeal filed by the Tinajo City Council, as published in the Official Gazette of the Canary Islands this Tuesday, October 11.
The appeal was filed by Alejando Válido Farray, representing the Tinajo City Council, against the Cotmac agreement of June 30, 2010, which approved the Environmental Report and the Final Approval of the Special Plan for the Protected Landscape of La Geria. This appeal by the City Council joins others filed by individuals.
The mayor of Tinajo, Jesús Machín, explains that the City Council filed this appeal because it "does not agree" with what was approved. "Things were agreed upon, which were not included in the approval later," he says. In this sense, and among other issues, Machín points out as an example that in this area "there are houses that have been there all their lives, with two floors, that would now be outside the planning regulations." "And we are against this," adds the mayor of Tinajo.
Now, the Government of the Canary Islands orders that the file be sent to the TSJC, so that it is included in the proceedings of the administrative litigation appeal, filed by the Tinajo City Council.
It also summons anyone who may appear as interested parties to, if they so wish, "appear and present themselves in the aforementioned proceedings within nine days and, in particular, the Cabildo of Lanzarote and the city councils of Tinajo, Yaiza, Tías, Teguise and Haría."
