The Superior Court of Justice of the Canary Islands has rejected the appeal presented by the Canarian Coalition and has confirmed the precautionary measure that suspended the expulsion of Councilor José Manuel Sosa from his political group in the Cabildo.

This procedure was initiated by Sosa, who last February already obtained precautionary measures from the Contentious-Administrative Court number 2 of Las Palmas de Gran Canaria, until the merits of the lawsuit are resolved. Afterwards, he also went to the criminal route, first for an alleged crime of coercion by Pedro San Ginés and then for another of documentary falsification. After the indictment in that case of all the CC councilors, for the alleged falsification of its regulations, the Contentious Court decided to suspend the lawsuit that was being processed, until the criminal procedure is resolved.

The Canarian Coalition then appealed that decision, but the TSJC has rejected its claims, with an order issued on July 22, the content of which has been made public this Tuesday by the Cabildo.

"The alleged falsification of the Regulations of the Canarian Coalition Group, denounced by Sosa and investigated by the Investigating Court number 2 of Arrecife, would imply, in the event that such falsehood is confirmed, that the expulsion of Juan Manuel Sosa had its legal support in a false document and would imply rendering the aforementioned expulsion without effect, beyond the consequences that it would entail for the perpetrators of the crime," they point out from the government group in a statement.

The president of the Cabildo, María Dolores Corujo, has expressed her "satisfaction" with this new judicial resolution that "breaks once again the strategy of the Canarian Coalition, aimed at obtaining the consideration of Juan Manuel Sosa as a defector, within a broader strategy."

"It must be remembered that everything began with an attempt by Pedro San Ginés to coerce Juan Manuel Sosa to abandon his position, as the councilor has denounced before the Court, which continued with up to four completely irregular expulsion attempts and an intense press campaign," says the president.

"No matter how much the Canarian Coalition dislikes it, the administrative situation of the councilor is irreproachable and he enjoys all his political rights. Others are currently being investigated by the justice system precisely for their pressure and for the use of a non-existent document that suddenly appeared in the procedure," added Corujo.

The expulsion of Sosa from the nationalist group implied his passage to the group of non-attached members, "severely limiting his political rights." However, that measure remains suspended as a precautionary measure until the lawsuit is resolved, and that will not happen until the criminal route is resolved first, to determine if the expulsion was based on a falsified document.
