The Public Prosecutor's Office has already presented its indictment in a separate piece of the Yate case, in which it is asking for 6 years in prison and 10 years of disqualification for the main defendant, the lawyer Felipe Fernández Camero, for the "arbitrary plunder of public funds" from the Yaiza City Council. According to the prosecutor Ignacio Stampa's brief, Camero charged the Consistory nearly one million euros outside the law, since there is no record of his legal hiring or the services provided to justify these payments.

Along with the lawyer, the former mayor of Yaiza, José Francisco Reyes, for whom the Prosecutor's Office is asking for 6 more years in prison and ten years of disqualification, is accused in this piece; the former secretary of the City Council, Vicente Bartolomé Fuentes, for whom he is also asking for six years in prison and ten years of disqualification; and the official Antonio Fernández Martín, who during a period in which the events occurred acted as secretary-intervenor of Yaiza. For him, the Prosecutor's Office is asking for 5 and a half years in prison and 9 years of disqualification.

In addition, the prosecutor demands that all of them be sentenced to pay significant sums as civil liability, to return to the Consistory the money allegedly embezzled. Specifically, he demands that the defendants indemnify the Yaiza City Council "jointly and severally" with 842,721.28 euros in the case of Reyes, 726,260.56 euros in the case of Bartolomé Fuentes and 115,742.63 euros in the case of Fernández Martín. For his part, Fernández Camero is claiming compensation of 970,752.28 euros. Of that amount, "the company Adelfas 24 SL will be subsidiarily liable in the amount of 311,727.63 euros", since part of the money was invoiced through that company.

All four are accused of a continued crime of embezzlement of public funds and another of prevarication (in the case of Fernández Camero, as an instigator). In addition, Fernández Martín must answer for a crime of falsification of an official document and Felipe Fernández Camero for another continued crime of falsification of a commercial document.

A twist in the investigation

During the investigation of the Yate case, for the massive granting of illegal licenses in Playa Blanca, the lawyer Felipe Fernández Camero was charged since the Prosecutor's Office considered that he acted as the mastermind of the alleged criminal plot.

However, finally the prosecutor himself asked to file the charges against him, because although he understood that there were indications, it was not sufficiently proven that Camero was the advisor to Reyes and the City Council to know those permits against the regulations. However, precisely for that reason, the prosecutor then asked to open a new piece against Camero for embezzlement. And it is that if there was no documentary evidence of his advice to the Consistory, he understood that there was no justification for the monthly payments he received for years from the City Council.

In addition to this procedure, Felipe Fernández Camero is charged and was even arrested in the Unión case. In a piece of that case, which continues in the investigation phase, he is being investigated for his time as secretary of the Arrecife City Council, specifically during the time of María Isabel Déniz in the Mayor's Office.
