The Cabildo of Lanzarote will appeal the order of the Contentious-Administrative Court number 5 of Las Palmas de Gran Canaria, which has dismissed the request for approval of the agreement between the first island institution and the Haría City Council to execute the sentence that condemned the first institution to compensate the northern city council for the conflict of the Cueva de Los Verdes.
As La Voz has already reported, the Court has argued as the basis for its resolution the non-inclusion of default interest in the amount to be paid by the Cabildo, stating that the sentences must be executed in their own terms without it being possible to declare the total or partial unenforceability of the ruling, unless there are causes of material or legal impossibility of executing due to specific circumstances.
However, the Cabildo argues that "the agreement reached does not intend at any time to disregard the interests." On the contrary, it affirms that "both administrations state them in the agreement and compensate them with part of the principal, given that there was a discrepancy when fixing the exact date on which the Cave, in compliance with the sentence, was made available to the City Council".
“This is a technical issue that we will discuss in court, but which, in any case, explains the refusal of the previous government group, both from the Cabildo and Haría, to submit the agreement for judicial approval,” says the president of the Cabildo, María Dolores Corujo.
"If the Court has pointed out the absence of default interest as the basis for non-approval, we must think about how it would have ruled if the addendum had not been approved. The agreement we inherited from Pedro San Ginés and Marciano Acuña did not even establish the principal of the debt and guaranteed Haría only fifty percent of the amount owed," added Corujo.
The president concluded by expressing her confidence that the agreement formalized by the previous government group can be approved thanks to the addendum signed after the appropriate appeal that will be filed in the coming days.
