The Canary Islands Commission for Territorial Planning and Environment (Cotmac) has approved this Monday "definitively and partially" the Special Plan for the Protected Landscape of La Geria, which was annulled by the Superior Court of Justice of the Canary Islands (TSJC). However, Cotmac has suspended the final approval of "determinations and areas" considering that there were "substantial modifications" that must be submitted again to a public information process.
The "areas" that must undergo this process are, "regarding zoning, the expansions of the moderate use zones of Montaña Blanca, Juan Bello, Volcán II (Igualén and El Alto) and the moderate use zone of Guatisea." These areas will also have a hearing process with a six-month deadline.
The Minister of Public Works, Transport and Territorial Policy of the Government of the Canary Islands, Domingo Berriel, chaired this meeting of Cotmac, in which the environmental report of the Special Plan of La Geria was also approved. According to this agreement of Cotmac, the "structuring" facilities are "entirely recategorized as Rustic Land for the Protection of Infrastructure and Equipment."
Additionally, in the rural settlements of El Islote and Caldereta, "the minimum building-suitable unit of 500 square meters, which appeared in the initially approved document," is established. Similarly, in the rural settlements of Mozaga and La Florida, a new ordinance has been incorporated, and the road layout of other settlements has been established.
A plan annulled in March 2012
The Special Plan for the Protected Landscape of La Geria was annulled on March 14, 2012, by the Superior Court of Justice of the Canary Islands (TSJC), which upheld the appeal filed by the owners of a property against the Cotmac agreement that gave the green light to the environmental report and definitively and partially approved this document.
The ruling considered that during the approval process of the Special Plan of La Geria, a series of "substantial" modifications were made, and in light of these changes, the reports indicated the "need for a new public information process," which was not carried out.
