The Criminal Court Number 1 of Arrecife has sentenced a Chinese citizen to a prison sentence of six months for a crime against industrial property and will also have to compensate several brands with 140,858 euros for selling their counterfeit products. In addition, he will have to pay a fine of 3,600 euros.
This man owned an establishment in the El Trébol shopping center, in Costa Teguise, where the Civil Guard went on November 1, 2007 and seized a multitude of allegedly branded objects. Specifically, the Civil Guard intercepted in this store 245 watches, 193 bags, 134 glasses, 115 plates, 93 necklaces, 60 earrings, 50 wallets, 36 rings, 13 bracelets, 6 stickers and 3 belts with different anagrams of different brands.
The quality of fabrics, the sewing system and labeling of the objects seized by the agents were "of lower quality than those used by registered trademarks." In addition, according to the ruling, they had been acquired "at a price notoriously lower than usual and with knowledge that they were not authentic brand effects."
The objects were intended for sale at a price "significantly lower than usual in authentic products", although the exact number of objects that were put on sale by the convicted person is not recorded.
The trial against this citizen took place on February 28, 2013 and it was he himself who expressed his "agreement" with the facts that were imputed to him, so he accepted that a "conformity sentence" be issued "without further formalities."
In addition to the six months of prison, this citizen will have to compensate different brands with a total amount of 140,858 euros. Specifically, he has been sentenced to pay Luis Vuitton the amount of 1,200 euros; 78,836 euros to Guccio Gucci; 18,466 euros to Play Boy; 140 euros to Nike; 100 euros to Guess; 21,000 euros to Cristian Dior; 100 euros to Versace; 196 euros to Calvin Klein and 20,820 euros to Channel. In addition, he must pay legal interest.
The sentence also specifies that the effects seized in the establishment must be confiscated and destroyed. This judicial ruling also specifies that other brands, such as Adidas, Boss, Prada, Armani, Tommy Hilfiguer and FC Barcelona, decided to waive compensation in this case
