The magistrate of the Criminal Chamber of the Supreme Court, Vicente Magro, in his capacity as instructor, has agreed to the free dismissal and the definitive filing of the case opened last January to the senator and former president of the Cabildo of Lanzarote Pedro Manuel Sanginés Gutiérrez, ruling out that the investigated facts "constitute a crime of false accusation and false testimony."
The judge makes the decision after taking a statement as investigated to the senator last Tuesday, April 16.
In a 17-page order, the instructor concludes that "there was no intention on the part of the senator to lie in his testimony about alleged irregularities in the contracting related to a certain company and its managers."
In addition, "he adds that the fact that the judicial investigation for said irregularities concluded in a dismissal order cannot automatically imply a demand for criminal liability from the complainant."
“This happens very frequently in criminal investigation proceedings as a result of complaints filed that do not have to be false due to the circumstance that after a long investigation process the proceedings are dismissed,” the order states.
The decision to dismiss is added to the one adopted this Thursday by the Criminal Chamber of the Supreme Court in relation to another matter also related to the person with parliamentary immunity Pedro Sanginés, in which alleged crimes of abuse of power, fraud against the administration, influence peddling, misappropriation and professional disloyalty are investigated.
The Chamber agreed not to admit the case against the person with parliamentary immunity and agreed to file the proceedings with respect to him, with the return to the Arrecife investigating court number 4 of the matter so that it can continue with the investigation of the facts, with respect to the aforementioned extremes or in relation to the action of the non-immune persons mentioned in the Reasoned Statement sent by the judge to the Supreme Court. That case refers to the irregular hiring of a lawyer in public companies in Lanzarote.
