The Criminal Chamber of the Supreme Court has ratified the sentence against the cook who murdered his boss in a premises in Puerto del Carmen. The events date back to August 1, 2019, when he was working at the Las Vegas restaurant in the Marítimo Shopping Center located on Avenida de las Playas.
The murderer was sentenced by a Jury Court to 17 years in prison for a crime of murder with treachery and the mitigating circumstance of psychic alteration. The sentence was later ratified by the Superior Court of Justice of the Canary Islands. After that, the convicted person filed an appeal in cassation before the Supreme Court, which has now been dismissed.
As proven facts, the judicial ruling reflects that on August 1, 2019, at 2:15 p.m., the cook had a verbal argument with his boss, who ran the business. After that, the chef went to the kitchen and grabbed a sharp knife and went to the owner of the business who was sweeping the place.
Attacking him from behind, he grabbed his head by the forehead and cut his neck. After that, the victim went out on his own foot to the street and wandered aimlessly and bewildered with the open wound. The aggressor then inflicted a second cut on him in an alley, which severed his jugular vein.
People who tried to help him could do nothing to prevent his death. The victim had three children between the ages of one and six at the time of death.
Thus, the Supreme Court has also ratified the absolute disqualification during the term of the sentence and the payment of the procedural costs caused in the procedure. In addition, he must compensate the victim's widow and her three children with 200,000 euros for the moral damage caused by the death of her husband and her children.
Meanwhile, the convicted person will not be able to access the third prison grade until he has served half of the custodial sentence.
