A jury of the Audiencia de Las Palmas has declared this Friday guilty the cook accused of murdering his boss with two stabs in the neck on August 1, 2019, in Puerto del Carmen.
In the reading of the final verdict, the jury has considered proven that Federico E. M. intentionally caused the death of Rachid B.C. after stabbing him in the neck when the victim was caught off guard while doing cleaning work.
According to the jury, the cook, surprisingly and from behind, grabbed the victim by the forehead with his left hand and cut his neck on the left side with a "mortal incision".
After receiving the first stab, Rachid was able to leave on his own feet to the street and wandered aimlessly, covering the wound with his hands while asking for help.
However, the accused followed him while carrying the knife until, at the height of an alley about 35 meters from the restaurant, he gave him another stab with which he severed the entire jugular vein, without any possibility of defending himself from any of the attacks perpetrated.
In addition, the members of the jury have also established, based on the testimonies of the doctors and psychologists who have intervened in the trial, that the accused acted at all times being aware of what he was doing, against the arguments of his defense that alleged that the cook suffered from borderline personality disorder, an anxious-depressive disorder and dissociative amnesia.
The jury has believed proven that at the time of the action Federico E. M. suffered from borderline personality disorder and anxious depressive syndrome, which slightly limited his capacity for judgment and will.
During the trial, the detainee assured that he did not remember what had happened because he lived it "like a movie" that was "horrifying" him.
On the other hand, the jury considered that Federico E. M. did not act with the desire to increase and prolong the victim's pain in an excessive way and, therefore, did not have the objective of causing him unbearable suffering.
Likewise, and based on the testimonies provided, the jury has not considered proven that the relationship with the boss was very bad and that he continually humiliated and reprimanded him, as well as that the working conditions of the accused and the work environment were bad and caused the cook to lose 20 kilos.
For all these reasons, the Public Prosecutor's Office has ratified its indictment, in which it requested 19 years and 6 months to concur the attenuating circumstance of anomaly or psychic alteration, as well as the payment of compensation of 100,000 euros to the widow and the three children of the victim.
The private prosecution, in view of the fact that cruelty has not been proven, has modified its request and has adhered to that of the Prosecutor's Office.
The defense, for its part, has shown its disagreement with the assessment of the jury and has expressed its intention to appeal the sentence.
