The Second Section of the Provincial Court of Las Palmas has acquitted a man accused of raping his ex-partner in his house in Arrecife. The judicial ruling considers that the versions of the complainant and the accused are "contradictory" and that it has not been proven what really happened, nor has the presumption of innocence been overcome.
The reported events date back to November 13, 2022, when the accused D.R.I. allegedly sexually assaulted his ex-partner, with whom he had been for four years. The court has based its decision on the "doubts" that arose when hearing the complainant, who was the sole witness to the events as it was a sexual encounter in the accused's private residence.
The Chamber states that the woman contradicted herself on "some points" considered relevant by the Provincial Court during her statement before the Court with respect to what was declared in her police report.
However, the Court explains that since the events were reported in November 2022 and the case was judged in June 2026, it is normal for statements to vary, but these variations should not change the essence of the account. At the same time, it points out that there are no peripheral elements, such as injuries or marks, to corroborate the assault.
Meanwhile, the accused, now acquitted, maintained at all times that the sexual relationship was consensual and that the complainant did not accept that he did not want to continue their relationship.
The Public Prosecutor's Office requested that he be sentenced to twelve years in prison and stated that the woman suffered symptomatology associated with symptoms of depression, such as apathy, avoidance of activities, feelings of helplessness, anxiety, nervousness, sleep problems, and loss of appetite after the reported events.
